Box 520 Pleasanton, CA 94566 ATTACHMENT 2 PREANNEXATION AND PROVISION OF WATER AND SEWER FACILITIES AND SERVICE AGREEMENT THIS AGREEMENT is made this day of _, 2007 between the City of Pleasanton, a municipal corporation (City) and Daniel L. and Cindy L. Marks (Owners). RECITALS A. Owners are the owners of certain real property located at 6352 Alisal Street (APN 949-0015-005-02), Pleasanton, CA, more particularly described in Exhibit A (the Exhibit A property) and incorporated herein by reference. B. Owners wish to connect the Exhibit A property to the City sewer system in order to eliminate the need to repair and reconstruct an existing septic tank and leach field system. C. Owners may wish to connect the Exhibit A property to the City water system at a later time to eliminate reliance on an existing water well. D. Generally, City policy requires property to be annexed prior to extending such City services as water and sewer service. E. Owners are willing to annex the Exhibit A property either as part of a larger annexation or as part of a smaller annexation involving properties and other property contiguous to the City. F. The public health, safety, and welfare of the City's residents are well served by eliminating the need for water wells and septic tanks and by connecting to the City's water and sewer system. G. City is willing to extend its sewer and water services only if there are assurances that the properties won't be further subdivided without approval of the City. NOW, THEREFORE, City and Owners hereby agree as follows: 1. Sewer and Water Service. Owners may connect to City's sewer and water systems prior to the City's annexation of the properties upon the satisfaction of the following conditions: (Marks Preannexation)
