18. Reviewed the Memorandum of Understanding between the Livermore-Pleasanton Fire <br />Department Joint Powers Authority and the International Association of Firefighters <br />Local 1974. <br />City Manager Fialho said staff was introducing the tentative agreement much the same way as <br />last year. It is a first reading of a proposal for Council review, consideration and public comment. <br />The item will be back before the Council on September 4, 2007 for a final review and <br />consideration and noted that the firefighters' contract expired on July 31, 2007. <br />Deputy City Manager Julie Yuan-Miu said Local 1974 represent 115 FTE's of a variety of <br />classifications, assigned to both Livermore and Pleasanton. On April 23, 2007, they convened <br />the JPA to discuss negotiation parameters and on the 30~' a joint Council meeting was held <br />between Livermore and Pleasanton to provide instruction to the negotiators in Closed Session <br />and reviewed the major terms of the agreement with the Council. <br />Public Comments: <br />Kay Ayala referred to the medical insurance and actual cost savings, said previously employees <br />were paying whatever the increase was, but if raised, employees would be capped and the City <br />would pay up to 15% of the increase. The City Manager clarified that the cap would be on the <br />increase--if the increase goes up 20%, the employee would pay 5% and the City would pay <br />15%. <br />Councilmember McGovern said with the work schedule changes, the performance indicators <br />are evaluating whether or not this works. Councilmember Sullivan confirmed with the City <br />Manager that the program is a one-year trial period. <br />MATTERS INITIATED BY COUNCIL <br />COUNCIL REPORTS <br />25. Brief reports on conferences, seminars, and meetings attended by the Mayor and City <br />Council. <br />Mayor Hosterman requested Council support or consideration to send a letter to the City's <br />Assembly member representative supporting the new legislation that residents alluded to earlier <br />to protect renter's rights. <br />Councilmember Thorne said nothing was done with the Staples Ranch area on the land use <br />element and he questioned whether the Council felt a strong enough message has been sent <br />that they would continue to move forward with the MOU. Councilmember McGovern noted a <br />workshop would be held and Councilmember Thorne noted this has been delayed due to delays <br />by the developers and reiterated the Council was continuing to move forward with the process. <br />Councilmember McGovern questioned whether or not public comment period was 5 minutes <br />based on Council procedures, and whether or not the Council could limit public comment if there <br />was a significant number of speakers. City Attorney Roush said there was no expressed <br />speaker time in the Council policies and procedures, said the rule is that the public should have <br />the opportunity to express their comments on matters on the agenda and not on the agenda. He <br />said some Council's have adopted expressed time rules and staff agreed to follow-up on <br />City Council Minutes 16 August 21, 2007 <br />
