Resolution No. PC-88-97
Page 2
September 14, 1988
As proposed and conditioned, the use complies with
all zoning regulations; and
WHEREAS, the Planning Commission finds that this project is
categorically exempt from the requirements of the
California Environmental Quality Act.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON
RESOLVES AS FOLLOWS:
Section 1. Approves Case UP-88-23, the application of John
Stanley for a conditional use permit to operate a bar at
an existing commercial structure located at 354 Main
Street subject to the following conditions:
1. The proposed use shall occupy only the proposed new
building, Case Z-88-212.
2. The proposed use shall be operated in conjunction
with a full-service restaurant containing a minimum
3,000 sq. ft.
3. No loitering, public drinking or excessive noise
shall be generated by the use.
4. The applicant shall maintain the area surrounding
the bar tenant space in a clean and orderly manner
at all times.
5. In the event nuisances are created through the
operation of the bar's use, either within the bar
itself or by patrons of the bar in the vicinity of
the bar, the City may require the bar to cease
operation. Determination as to whether a nuisance
is created shall be made by the Planning
Commission, following a hearing process as set
forth in the Municipal Code for review and
revocation of conditional uses.
6. Upon application of a bar tenant for a zoning
certificate, the Planning Director may choose to
have the actually proposed bar operation reviewed
by the Planning Commission. The Commission may
establish additional conditions at that time
relating to the operation of the proposed bar. In
any event, the use permit shall be reviewed by
staff with optional referral to the Planning
Commission within 12 months to determine compliance
with these conditions of approval. Additional
conditions may be attached, as determined necessary
by the Planning Commission at such review.
