PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-88-100 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR <br />TRIM 'N' TONE AS FILED UNDER CASE UP-88-36 <br />WHEREAS, Trim 'N' Tone has applied for a conditional use permit <br />to operate a health spa/fitness center within the retail <br />commercial center located at 4040 Pimlico Drive; and <br />WHEREAS, zoning for the property is PUD (Planned Unit <br />Development) - Commercial District; and <br />WHEREAS, at their duly noticed public hearing of September 14, <br />1988, the Planning Commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, the Planning Commission made the following findings: <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the Zoning <br />Ordinance and the purpose of the Commercial <br />District. <br />The proposed use requires relatively simple <br />physical facilities in which to operate. The <br />commercial complex can provide an appropriate <br />environment in which an instruction-oriented use <br />would be compatible with the adjacent tenants. The <br />Planning Commission feels that the proposed use is <br />consistent with the objectives of the Commercial <br />PUD District in which it is located. <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />The proposed use should not adversely affect the <br />availability of parking spaces in the shopping <br />complex. The proposed use is operated entirely <br />indoors and activities should not interfere with <br />the adjacent uses. No excessive noise or trash is <br />expected to be generated by the use. The proposed <br />use will, therefore, not be detrimental to the <br />public health, safety, and welfare nor will it pose <br />a threat to surrounding properties or <br />improvements. <br />
