number of businesses that have children on-site, such as family childcare facilities, as well as <br />some commercial operations depending on length of time they are open, have to be licensed by <br />the State and includes signing in and out, ratio, and background checks and fingerprinting. She <br />added that one of the things that the Commission has been doing for those child-related <br />businesses that do not need a State license for operation is to require the parents to sign their <br />children in and out. <br /> <br />Commissioner Narum noted that this business has been in operation at another location for a <br />number of years and inquired if this condition was required of this business at that time and if <br />they had a track record. <br /> <br />Ms. Amos replied that the business was previously located in the Downtown and that the <br />Planning Commission first granted its conditional use permit in 2003. She indicated that the <br />business did not have any condition similar to signing in during that period. <br /> <br />Ms. Decker added that the business had not received any complaints from parents or other <br />businesses and that there had been no Code enforcement issues as well. <br /> <br />Commission O’Connor stated that since safety is within the purview of the Commission, it is <br />important, when it comes to children, to have something in place that would ensure that the <br />project would not be detrimental to the public health and safety. He added that if there were no <br />condition in place, it would be difficult to enforce this should a dangerous situation or an <br />unwanted behavior arise. <br /> <br />THE PUBLIC HEARING WAS OPENED. <br /> <br />There were no speakers. <br /> <br />THE PUBLIC HEARING WAS CLOSED. <br /> <br />Commissioner Blank moved to make the required conditional use permit findings as listed <br />in the staff report and to approve PCUP-187, subject to the conditions of approval listed in <br />Exhibit B of the staff report, as recommended by staff, with the addition of a condition that <br />children 12 years old and under be picked up and dropped off and signed into and out of <br />the facility by their parents, guardians, or supervising adults. <br />Commissioner Pearce seconded the motion. <br /> <br /> <br />ROLL CALL VOTE: <br /> <br />AYES: Commissioners Blank, Fox, Narum, Olson, and Pearce. <br />NOES: None. <br />ABSTAIN: None. <br />RECUSED: None. <br />ABSENT: None. <br /> <br />Resolution No. PC-2007-09 approving PCUP-187 was entered and adopted as motioned. <br />PLANNING COMMISSION MINUTES February 28, 2007 Page 4 of 13 <br /> <br /> <br />
