If they are not able to reach an <br />agreement that the residents and the Council can support, then the ordinance will go into <br />effect in August. <br />Mayor Hosterman expressed a desire to schedule opportunities for Councilmembers to <br />visit the Park. <br />In response to question by Councilmember Thorne, the City Attorney noted the <br />maintenance issues are under the control of the State Department of Housing and <br />Community Development and the City's ability to regulate them is more difficult than <br />throughout the City. On the other hand, there are general maintenance responsibilities <br />under the agreement and that is the leverage that the City has tried to use to get the <br />owner to do something out there in the interim. It has been difficult to get voluntary <br />cooperation. <br />It was noted that letters to the State Department of Housing and Community Development <br />would be helpful as well. <br />Joseph Partansky addressed the Council regarding public participation and referenced the <br />wording on the Agenda Coversheet which reads ".....the Mayor will generally allow public <br />input on any item listed on the agenda...." He indicated the law states you must allow <br />comments. He asked if you keep the language as stated, perhaps there should be a <br />statement where comments are not allowed so as to be more informational. In addition, <br />referring to Council Reports, he noted it would be nice to have reports out by Boards and <br />Commissions -perhaps quarterly or once a year. <br />PUBLIC HEARINGS AND OTHER MATTERS <br />18. Pulled from the agenda -Public Hearing: Status report regarding community needs for <br />medical marijuana, Alameda County's Identification Card Program, dispensaries within the <br />County, and effects of dispensaries operating in other jurisdictions, and consider <br />introduction of an Ordinance to add a new Chapter 6.18 to the Municipal Code to prohibit <br />the operation of medical marijuana dispensaries <br />19. Consider recommendation of the Happy Valley Blue Ribbon Committee (HVBRC) for the <br />Bypass Road realignment and adopt a resolution thanking the committee for completing its <br />purpose. <br />Julie Yuan-Miu, Deputy City Manager, gave the staff report and noted the Happy Valley Blue <br />Ribbon Committee was established by the Council in June 2006 and was asked to provide a <br />recommendation to the Council related to the Callippe Preserve Golf Course bypass road <br />alignment. The Committee began meeting later that month and concluded their activities in <br />November 2006. As the Committee has completed the task, its recommended that the <br />Council disband the committee. She noted Loris Tinfow handled this project and would be <br />making the presentation. <br />Loris Tinfow gave a presentation and noted that the committee was charged with the task to <br />discuss the previous alternatives that had been evaluated related to a bypass road <br />alignment as described in the Happy Valley Specific Plan, review new information, and <br />collaborate towards finding a preferred alternative for a bypass road alignment that would <br />City Council Minutes 5 April 17, 2007 <br />
