construction and financing constitute governmental affairs of <br />the City; <br /> <br /> WHEREAS, City of Pleasanton Public Facilities <br />Corporation (herein called the "Corporation") is a nonprofit <br />corporation formed to render financial assistance to the City <br />by financing the acquisition, construction, improvement and <br />remodeling of public buildings and facilities for the City; <br /> <br /> WHEREAS, by its Articles of Incorporation and by its <br />Bylaws no part of the net earnings, funds or assets of said <br />Corporation shall inure to the benefit of any director thereof <br />or any other person, firm or corporation, except the City of <br />Pleasanton; <br /> <br /> WHEREAS, the City has full legal right, power and <br />authority to enter into a facility lease with the Corporation <br />of a water reservoir and pipeline located in the County of <br />Alameda, California and designated as Sycamore Water Reservoir <br />(herein called "Capital Project I") and of certain office <br />facilities located at 123 Main Street in the City of <br />Pleasanton, California (herein called "Capital Project II"); <br /> <br /> WHEREAS, this City Council hereby determines that it <br />would be in the best interest of the City and the residents of <br />the City for the City and the Corporation to enter into a <br />lease, entitled "Site Lease (Capital Project I)" and <br />tentatively dated as of October 1, 1987 (herein called the <br />"Site Lease"); <br /> <br /> 2 <br /> 1549S <br /> <br /> <br />
