<br />Mr. (serson said a bridge across the Arroyo is not currently being considered; however, it <br />could be one of the options that could be considered when the discussion of the emergency <br />EVA is revived and its preferred alignment. <br /> <br />Mr. Sullivan asked if the setback from the Arroyo for this project was similar to the <br />distance from the Nolan Farms subdivision? <br /> <br />Mr. Iserson said yes. He noted the setback varied somewhat along Nolan Farms. He <br />believed the setback from the Arroyo for this project was approximately 20 feet from the top of <br />the bank to the road with a trail within that area. He noted that the road could potentially <br />connect to the Nolan Farms subdivision if the Jones property were ever developed. <br /> <br />Mr. Sullivan inquired about the Jones family's issues. He believed the staff report <br />mentioned staff was involved in a discussion process with the Jones family and the applicant to <br />attempt to reach some type of an agreement. It was his understanding that at some point, <br />either the applicant or the Jones family did not want staff to participate any further in these <br />discussions. <br /> <br />Mr. Iserson said staff was informed by a member of the Jones family that the Jones <br />family did not want staff to participate in any further discussions. <br /> <br />Mr. Sullivan asked if the proposed conditions of approval addressed the issues up to the <br />point where the City was participating in the discussions? <br /> <br />Mr. Iserson said yes. <br /> <br />Ms. McGovern asked if Zone 7 owned any land within the Arroyo behind the Nolan <br />Farms subdivision? <br /> <br />Mr. Iserson said yes. <br /> <br />Ms. McGovern asked why Zone 7 would not want to continue ownership with this <br />project? <br /> <br />Mr. lserson said Zone 7's policy has changed in this matter. Staff has assumed that any <br />projects built adjacent to the Arroyo would be built according to Zone 7's standards. Zone 7's <br />policy has been to take over ownership and maintenance of the Arroyo. Staff was surprised in <br />this particular case when it heard that Zone 7 was no longer interested in pursuing ownership of <br />the Arroyo in instances where there is development adjacent to it. If Zone 7 elects not to <br />assume ownership, the homeowners association of the Roselyn Lane project would be <br />responsible for maintenance of the Arroyo embankment. <br /> <br />Ms. McGovern asked if it would be difficult for the homeowners association to have to <br />maintain the Arroyo embankment? <br /> <br />Mr. Iserson said it would be an added maintenance responsibility. Typically, <br />maintenance of the Arroyo involved removing a tree that has fallen down or shrubs that have <br />gotten in the way during a storm. The chances of a catastrophic failure of the slope bank, <br />where there would be a slide into the creek, are small as substantiated in the geotechnical <br />report. <br /> <br />Pleasanton City Council <br />Minutes <br /> <br />6 <br /> <br />01/17/06 <br />
