Mr. Roush said Chapter 7.36 of the Municipal Code addressed animal nuisances, which
covered dogs, cats, chickens, pot bellied pigs, etc.

For clarification purposes, Mr. Fialho asked if the motion omitted the proposed sections
related to shelter, protection and adjacency to neighbor's backyards in terms of chicken coops?

Mr. Brozosky said yes.

The roll call vote was taken as follows:
AYES: Councilmembers - Brozosky, McGovern, Sullivan, and Mayor Hosterman
NOES: None
ABSENT: Council member Thorne
ABSTAINED: None

6b
Modification of the Residential Permit ParkinG Ordinance. (SR 06:016)

Rob Wilson, Director of Public Works, presented the staff report.

In response to an inquiry by Mr. Brozosky, Mr. Wilson said the proposed ordinance
would allow for the use of residential permit parking addressing the parking concerns on the
Santa Rita Frontage Road or anywhere else in the City. If there were a concern for any area
that had other parking issues, residents would be required to appear before Council and request
that they be allowed to have permit parking.

Mr. Fialho clarified that Council was not only amending the Residential Permit Parking
Ordinance but was also establishing the parking permit process for those four residences facing
Santa Rita Road.

In response to an inquiry by Mr. Brozosky, Mr. Roush said when this matter returned to
Council at its January 17 meeting for second reading and adoption of the ordinance, the staff
report would include a specific item that addressed the establishment of the parking permit
process for those four residences facing Santa Rita Road. Staff would notify these residents so
that if there were any concern about implementing it as to that area, they would have a chance
to be heard.

Mr. Wilson said staff provided public notice to the immediate area because it was an
amendment to the ordinance.

Ms. McGovern said when she asked staff how the permit parking process worked, she
was informed that the Police Department regulated the permits, that the permits are official
looking and that stealing them or removing them from a vehicle destroyed the permit so that it is
something that actually adhered to the windshield. Staff also informed her that residential
permit parking was currently available in the Jensen and Muirwood residential neighborhoods
and it was working.

Mr. Fialho said that was correct.

Mayor Hosterman opened the public hearing. There being no public comments, the
public hearing was closed.

Pleasanton City Council
Minutes

8

01/03/06
