MEETING OPEN TO THE PUBLIC <br /> <br />Other Soeakers <br /> <br />Jerry Wagner, a Happy Valley resident, addressed Council regarding whether the <br />Council was observing its own Community of Character. <br /> <br />There were no other speakers. <br /> <br />6. PUBLIC HEARINGS & OTHER MATTERS <br /> <br />6a <br />PRZ-30. City of Pleasanton (SR 06:015) <br />Consideration of amendment to Chapter 18 and related sections of the Pleasanton Municipal <br />Code to allow the keeping of chickens in designated zoning districts without discretionary review <br />of a public hearing. (SR 06:015) <br /> <br />Jerry Iserson, Director of Planning and Community Development, presented the staff <br />report. <br /> <br />Mr. Brozosky asked if the reason for not allowing male chickens was due to noise? <br /> <br />Mr. Iserson said yes. <br /> <br />Mr. Brozosky noted that the proposed ordinance addressed keeping the area clean and <br />healthy and asked if the City already had an existing ordinance that regulated animals in <br />backyards and all of the health issues associated with it? <br /> <br />Mr. Iserson said yes which is located in Chapter Seven of the Municipal Code dealing in <br />general with miscellaneous animal regulations. Staff believed it would be helpful to include <br />maintaining the chickens in a healthy condition in the Zoning Ordinance as a standard that <br />needed to be met in approving this particular use. <br /> <br />Mr. Brozosky found this to be confusing in the future where there might be several <br />sections of the Municipal Code that might conflict with each other. <br /> <br />Mr. Fialho suggested referencing Chapter Seven of the Municipal Code as an option to <br />identifying the terminology, which addresses standard animal husbandry and relates to the <br />cleanliness of the chicken pens. He suggested the ordinance state the owner is responsible for <br />practicing clean and sanitary conditions at all times consistent with Chapter 7.36 of the <br />Municipal Code. Chapter 7.36 of the Municipal Codes currently states, "every person owning or <br />occupying premises where any animal, fowl or bird is kept shall keep the stable barn, stall, pen <br />coop, building or place in which the animal is kept in a clean and sanitary condition." <br /> <br />Mr. Brozosky pointed out a current City ordinance prohibits chickens from going outside <br />of the yards. <br /> <br />Mr. Iserson said this was referenced in Chapter 7.36.040 of the Municipal Code, which is <br />mainly for implementation purposes since the Planning Department uses and provides this <br />information to the public on items that reference the Zoning Ordinance.
