<br /> It was moved by Mr. Brozosky, seconded by Ms. McGovern, to authorize the City <br />Manager to sign the agreement with amendment to the agreement as proposed by <br />Council member McGovern; to approve the improvement plans and final map for Tract <br />7385, Avignon (Centex Homes); to authorize the City Manager to execute the Subdivision <br />Agreement for this development; to accept all parcels of land and easements offered for <br />dedication on the final map; and to adopt Resolution 05-063, a resolution determining <br />satisfactory compliance with conditions for canceling agricultural contract 1974-10B and <br />authorizing the City Clerk to prepare and record a certificate of cancellation. <br />The roll call vote was taken as follows: <br />AYES: Councilmembers - Brozosky, McGovern, Sullivan, Thorne, and <br /> Mayor Hosterman <br />NOES: None <br />ABSENT: None <br />ABSTAINED: None <br />Qg <br />Identification of alternatives to be evaluated in the environmental imDact reDort fEIR) for <br />the Bernal ProDertv Phase II SDecific PlanlBernal Community Park Master Plan Droiects. <br />(SR 05:224) <br /> Wayne Rasmussen, consultant, presented the staff report. <br /> In response to an inquiry by Mayor Hosterman, Mr. Rasmussen said Alternatives 1 and <br />2 must be studied and evaluated in the Environmental Impact Report (EIR) process. He noted <br />that both alternatives represent the most important issues to Council as expressed by the <br />community, which will allow Council to gain feedback through the EIR process on these items <br />and then review the preferred plan and select uses from that point. <br /> Mr. Brozosky noted that Alternative 1 included the ACE Train Station remaining at the <br />Fairgrounds site with a pedestrian bridge to be constructed over Bernal Avenue to connect the <br />Station with the Cultural Arts Center parking lot. He asked if there was a reason why this would <br />be a preferred alternative as opposed to a parking structure on the current site? He pointed out <br />that the preferred plan did not include the ACE Train Station. <br /> Mr. Rasmussen said that for the Preferred Plan, an evaluation would need to be <br />conducted to determine where an ACE Train Station might be located which would include <br />possible alternatives at the Fairgrounds and another site on Stanley Boulevard. <br /> Mr. Brozosky asked if an EIR or a Negative Declaration was required if a parking <br />structure was added to the current site for the ACE Train Station? <br /> Mr. Rasmussen did not know why it would require an EIR, it is only a substantial traffic <br />matter and the appearance of it could enter into the environmental concern. He believed a <br />mitigated negative declaration would be the appropriate avenue. <br /> Mr. Iserson concurred with Mr. Rasmussen. <br /> Mr. Brozosky asked if there were a number of minimum alternatives that were required <br />for evaluation in the EIR? <br />Pleasanton City Council 23 08/16/05 <br />Minutes <br />
