<br />, Mr. Roush presented the staff reports. <br />Mayor Hosterman mentioned that Ms. McGovern proposed an amendment to paragraph <br />six of the Centex Agreement. <br />Mr. Roush reminded Council that it had discussions with Granite Construction and RMC <br />Lonestar about the Asphalt Plant being moved by the 2009 timeframe. The proposed <br />amendment to paragraph six as proposed by Ms. McGovern provides that if the Plant was not <br />relocated by 2009, the City would retain the $562,500 or the $500,000 and the Council at that <br />time would revisit the issue and determine how these funds would be used. Staff supported the <br />proposed amendment, which is dependent upon whether Council wants to make the decision <br />now as to how these funds would be used or postpone it until a future time. <br />Ms. McGovern noted that staff discussed with Council the Asphalt Plant and the idea of <br />having it removed by 2009. If Council looked at the agreement with seven years it would <br />continue to 2012 and she wanted to reiterate to Granite Construction and to everyone involved <br />that Council believes the plant will be removed by 2009. To be consistent, she felt it was better <br />to use the date of 2009. <br />Mr. Roush said his rationale in stating that the relocation of the Plant would be within <br />seven years was because if for some reason the negotiations took longer to relocate the Plant, <br />the funds would still be available at that time for relocation purposes. <br />Ms. McGovern believed that if the Plant was not removed by December 2009, whatever <br />Council is seated should be addressing this issue. <br />In response to an inquiry by Mr. Brozosky, Mr. Fialho said if the waiver is granted, <br />$562,500 goes towards the relocation of the Asphalt Plant and the $500,000, which was the <br />contribution from Centex Homes, would be dedicated to energy efficiency projects. <br />In response to an inquiry by Mr. Brozosky, Mr. Roush said if the State waives the <br />$562,500 then this amount would be dedicated towards the relocation costs and the $500,000 <br />would be used by Centex Homes to install energy efficiencies within its homes within Tract <br />7385. <br />Mr. Brozosky was comfortable with the proposed amendment to paragraph six. He <br />wanted to make sure that if the City is collecting funds for mitigations in this area that these <br />funds be used specifically for mitigations and not pulled away while the City is in negotiations <br />with whoever owns the property at that point. <br />Mr. Roush said the Council in December 2009 could determine to retain the funds for <br />relocation purposes or dedicate it towards energy efficiency projects somewhere, or dedicate it <br />towards other improvements in the Vineyard area. <br />Ms. McGovern was hopeful that by January 31, 2006, Council would know if the waiver <br />was approved. If the waiver were not approved, the $500,000 would be what Centex's <br />contribution would be to move the asphalt plant. She was trying to give Council the most <br />flexibility.
