Mr. Rowe said the whip snake fence was temporarily installed during construction, and
subsequently a permanent fence was installed. The Department of Fish and Game believed the
fence was not necessary, as it was believed it would be a detriment in creating a habitat that
might influence any passing snakes. He noted that the permanent fence is shorter in height.

In response to an inquiry by Ms. McGovern, Mr. Rowe said Alameda New Communities
gave the Park District $135,000 to be budgeted for the purpose of an entrance from the West
Las Positas intersection to the trailhead of the Park, which has been included in the District's
master plan.

Ms. McGovern believed the staff report indicated that the Lemoines were going to
dedicate a one-acre parcel of land.

Mr. Rowe said the Lemoines dedicated one acre at the top of its property, which enabled
the Park District to connect to the Trail.

Mr. Fialho said staff met with the East Bay Regional Parks District Liaison Committee
regarding the matter. The Park District was not ready to open this area to the public, but the
long-term idea was to make this a staging area for access to that open space.

The roll call vote was taken as follows:
AYES: Councilmembers - Brozosky, McGovern, Sullivan, and Mayor Hosterman
NOES: None
ABSENT: None
ABSTAIN: None

General Plan Update Vision Statement.
