She asked if a developer would be risking its own future project if it <br />purchased Inclusionary Unit Credits, <br /> <br /> Mr. Bocian said a developer would be risking its own future project, and the City is not held <br />liable. <br /> <br /> Mayor Hosterman declared the public hearing open. <br /> <br /> Jack Dove, a Pleasanton resident, pointed out that the 1996 General Plan lays out the terms <br />for various categories of housing in the community. He believed nothing has been done to address <br />the very Iow-income housing needs in the community, particularly affordable senior housing. He <br />noted that Pleasanton Greens provides 131 units of affordable housing, which includes about 26 units <br />for seniors. There was a sunset clause on the agreement and when the agreement expired, the City <br />was not able to negotiate to renew the affordability. He noted that staff provided a report to Council in <br />January of 2004 which mentioned where potential housing was available, which included the Del <br />Arroyo Apartments which had about 150 units that were at one point in time, available for very-low <br />income senior housing. The City did not prepare a response to the request to upgrade these units <br />and to make this project affordable in perpetuity and as a result, a developer purchased this site, <br />which is now a profitable project. He feared that if Council did not take action this evening to give <br />some assurances to Mr. Auf der Maur with regard to City involvement with the vacant 2.76-acre site <br />on Vineyard Avenue, the potential for future development of a senior affordable housing project on <br />this site would be lost. He encouraged Council to find a way to work with Mr. Auf der Maur. <br /> <br /> Kurt Kummer, a Pleasanton resident, mentioned that the Trails Ad Hoc Committee is <br />interested in developing trails that would connect the downtown to the vacant 2.76-acre site on <br />Vineyard Avenue, Shadow Cliffs and eventually to Livermore. <br /> <br /> Mayor Hosterman closed the public hearing. <br /> <br /> It was moved by Mr. Brozosky, seconded by Mr. Sullivan to approve "Option A" as set <br />forth in the staff report and inform the property owner of the City's willingness to meet with a <br />prospective owner/developer of the subject property to maximize unit affordability in <br />accordance with the Inclusionary Zoning Ordinance and interests of the City Council. <br /> <br /> Mr. Sullivan indicated that he would like to amend the motion to include a policy statement that <br />Council wants to see a project with a significant amount of affordability for it to consider. <br /> <br /> Mr. Brozosky was not supportive of amending the motion. He did not want to take away <br /> anyone's property rights. He wanted to encourage a prospective owner/developer to maximize unit <br /> affordability and not hold the developer to it. <br /> <br /> Mr. Sullivan pointed out that Council would ultimately have approval of whatever project came <br />forward. He made a commitment to the community to do whatever he could to try and get some type <br />of affordable project on this site. He believed Council and the City needed to be in the position to <br />state and provide these types of needs for the community. The City would not be taking away <br />anyone's property rights. He believed it would be appropriate for Council to encourage a prospective <br />owner/developer to develop a project that has a significant amount of affordability. <br /> <br /> Ms. McGovern was uncomfortable with including stronger language in the motion. She noted <br /> that a senior housing project is being discussed for Staples Ranch, and she is interested in making <br /> sure there is affordability to this project because it is an age in place project.
