Greenbriar Homes will be constructing. All three of these agencies are in full support of
the project. The issue that staff has run into with respect to mitigation credits has to do
with the fact that a majority of this work will be constructed with grant funding, and the
City is unable to provide mitigation credits for pieces of work that are built using State
grant funds. Staff is trying to sort out how much of the project is constructed by State
funds, how much of the project will be constructed using City funds and how much of the
project is developer constructed. He is hopeful that when this matter returns to Council
for approval, all of these issues would be solved.

It was moved by Mr. Sullivan, seconded by Mr. Brozosky, to approve
Amendment One to the contract with LTD Engineering, Inc. in the not to exceed
amount of $72,000 and to authorize the City Manager to execute the amendment.

Mayor Hosterman believed it is important to do this right. Eventually, she
anticipates having a number of natural looking waterways, which will adequately drain
that area and address water issues, and also enhance the community park on a long-
term basis.

The roll call vote was taken as follows:
AYES: Councilmembere - Brozosky, McGovern, Sullivan, and Mayor
Hoaterman
NOES: None
ABSENT: None
ABSTAIN: None

There was a break at 9:05 p.m.

The meeting reconvened at 9:08 p.m.

6.~e
CamDaian Reaulationa- Discloeure Statementa. (SR 05:041)

Michael Roush, City Attorney, presented the staff report.

In response to an inquiry by Mr. Brozosky, Mr. Roush said the City of Pleasanton
and the State currently do not have a contribution limit on the amount of money that can
be contributed to a local campaign committee. The only State law that is applicable to
campaign contributions is for contributions of $100 or more, which must be disclosed.

In response to an inquiry by Mr. Brozosky, Mr. Fialho said that the City of Dublin
has a maximum contribution limit of $300, the City of Livermore has a maximum
contribution limit of $250, and the City of San Ramon has established a voluntary
agreement by the Counciimembers of $12,536 as the individual campaign expenditure
limit for the 2003 municipal election. He noted that the Cities of Dublin and San Ramon
have no special campaign disclosure requirements, but the City of Livermore requires a
candidate to individually disclose all contributions of $25 or more.

.... Mayor Hosterman invited public comments.

Pleasanton City Council 13 02/15/05
Minutes
