He was concerned <br /> the resident would think the agreement was invalid. <br /> <br /> Ms. Ayala believed the reason the original annexation election did not succeed was <br />because of the bypass road. <br /> <br /> Mr. Roush said the preannexation agreements have taken many forms over the <br />years. He noted several instances where circumstances demanded changes to the <br />language of the preannexation agreements. <br /> <br /> Mr. Brozosky asked if the bypass road location changed, would that complicate <br />things with regard to the agreement? <br /> <br /> Mr. Roush said the wording could state the "construction of a bypass road as shown <br />in the 1998 Happy Valley Specific Plan." <br /> <br /> Mr. Brozosky thought better wording would be to say, "where golf course traffic <br />would not be on Alisal and Happy Valley Roads". <br /> <br /> Ms. Ayala felt the issue was getting too complicated and Council was trying to do <br />staff's legal work. She requested the item be continued and have Mr. Roush bring back <br />additional language suggestions. <br /> <br /> Mr. Brozosky was concerned the Dees were going without a septic tank during this <br />postponement. <br /> <br />Mr. Wilson said the septic tank is functional at this time, but very near failure. <br /> <br /> Mr. Roush suggested Council approve the concept of the preannexation agreement <br />and direct staff to bring back more precise language concerning the issue of the bypass <br />road. That would allow the Dees to continue the process for connection to the City sewer <br />system. <br /> <br /> It was moved by Ms. Hosterman, seconded by Mr. Brozosky, to approve in <br />concept the preannexation agreement for the Dees property (6745 Alisal Street) and <br />for staff to bring back language linking annexation to the bypass road. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers - Ayala, Brozosky, Campbell, and Hosterman <br />NOES: None <br />ABSENT: Mayor Pico <br />ABSTAIN: None <br /> <br />Item 6a <br />AQreement with the Pleasanton Unified School District concerninq the construction <br />fundino for Neal Elementary (SR 04:220) <br /> <br /> Mr. Brozosky recused himself from this item since he owns property within 500 feet <br />of the project. <br /> <br />Nelson Fialho presented the staff report. <br /> <br />Pleasanton City Council 11 09/21/04 <br />Minutes <br /> <br /> <br />
