The property is located at 1875 Valley <br />Avenue - the southeast corner of Bernal Avenue and Valley Avenue - and is <br />zoned PUD-C-O (Planned Unit Development- Commercial-Office) District. <br /> <br />Mr. Swift presented the staff report. <br /> <br /> Mr. Campbell asked how specific the Covenants, Conditions and Restrictions <br />were for the homes that KB Homes built that were closest to the service station <br />complex? <br /> <br /> Mr. Swift said the City required the developer to disclosure these and other <br />potential uses when it approved the Bernal Property project, and KB Homes fully <br />disclosed the future service station complex, including a possible carwash and drive- <br />through restaurant. <br /> <br /> Mr. Brozosky seemed to recall that in the original design, the City asked the <br />property owner not to install a fence. <br /> <br /> Mr. Swift mentioned that the original Bernal Property Specific Plan discusses <br />having a waikable environment that integrates uses in a pedestrian friendly, urban <br />design way. There were about 15 potential different layouts in the initial stages of <br />working with the property owners to come up with a design for the service station. Given <br />the separation of the residential units to this site, staff felt that landscaping would suffice <br />and a fence would not be required. <br /> <br />Mr. Brozosky believed the City required the property owner to install a walkway. <br /> <br /> Mr. Swift was not sure whether the City encouraged or required the property <br />owner to install a walkway. Staff did believe that a walkway would be a valuable adjunct <br />to the project. <br /> <br /> In response to an inquiry by Mr. Campbell, Mr. Swift said that the Planning <br />Commission desired to have a walkway. <br /> <br />Mayor Pico opened the public hearing. <br /> <br /> Weldon Theobald, appellant, and partner in the Bernal Corners operation, stated <br />that Bernal Partners LLC is in complete compliance with the existing conditional use <br />permit. Bernal Parterns LLC requested that Council approve the project with the <br />appellants' modifications to include building a six-foot tall wood noise attenuation fence <br />on the eastern property line along the drive-through lane, and an eight-foot tall wood <br />noise attenuation fence built from the carwash entrance easterly and northerly to the <br />pedestrian walkway, and limiting the hours of operation for the carwash from 8:00 a.m. <br />to 9:00 p.m., Monday through Sunday. He asked for additional clarification regarding the <br />60 dBA requirement as it pertains to the City's noise ordinance as the only time a person <br />would experience noise levels of 60 dBA would be if they were walking down East Gate <br />Way. Bernal Partners LLC concurs with staff's recommendation regarding the carwash <br />signs and lights as listed in the staff report, and have removed the signs and lights <br />located at the east and west ends of the building and relocated one of the signs to the <br />north side of the building.
