Mr. Brozosky and Mr. Campbell said yes.

Mr. Brozosky noted that staffhad added Condition 125, which was the discount
for Pleasanton residents. He wanted to clarify this condition to state, "discount of season
passes and entry for Pleasanton residents." He asked Council if it believed it was
necessary for Pleasanton residents to receive a discount on both entry and season passes,
or did Council want to limit it just to entry?

Ms. Ayala wanted discounts for both season passes and entry fees.

Mr. Brozosky pointed out that Condition 41 states that noise generated by
mechanical equipment would not be perceptible beyond the property plane of the subject
property. He would also like to add the condition that the PA system will also not be
heard beyond the property plane. He was not sure that PA systems were mechanical
equipment but believed it was good to specifically state it. Condition 22 states that the
applicant shall work with CalTrans for the best routes. He would also like for the
applicant to work with the online direction providers to ensure that Airway Boulevard
and future Isabel Avenue is the preferred 1-580 exit to the Park. He wanted to ensure that
the BMX Park moved forward. He was concerned that if Council scaled back on the
Park, the BMX Park would be included. He asked ifa condition could be added that
would ensure that the BMX Park proceeded?

To date, Mr. Roush said that EBRPD has indicated that in its consideration to
provide that additional land to the City for a BMX Park, it was actually tied to the
project. EBRPD was looking to the income stream from the water slide park to help
offset some costs that it was trying to recover. Therefore, EBRPD needed to see whether
or not this project was going to proceed in terms of deciding whether or not to make that
land available. He believed Mr. Brozosky's condition would state that Council is
approving this subject to EBRPD agreeing to lease the City the site.

Mr. Brozosky said yes.

Mr. Roush said that this condition could be added if that is what Mr. Brozosky
desired.

Mr. Brozosky and Ms. Ayala wanted this condition added to the motion.

Mr. Campbell asked what would happen if the conditions were not met.

After the project is constructed and if the conditions are not met, Mr. Swift said
the applicant would be asked to bring the activity into compliance with respect to the
conditions. If this does not happen, it would be brought back to the Planning
Commission for its review and possible revocation of the Use Permit, which would cause
the water slide park to cease operation.

Ms. Host~m~an asked if an EIR was included as part of the motion?

Pleasanton City Council 20 03/30/04
Minutes
