CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 87-405 <br /> <br /> RESOLUTION LIFTING THE VINEYARD AVENUE MORATORIUM ON THE <br /> AMADOR VALLEY SAVINGS AND LOAN PROPERTY ONLY AND <br /> APPROVING CONTRACT WITH AMADOR VALLEY SAVINGS AND LOAN <br /> TO BUILD THE NORTHERLY EXTENSION OF BERNAL AVENUE <br /> <br /> WHEREAS, at its meeting of September 1, 1987, Chris Beratlis <br /> addressed the Council and indicated that if the <br /> ordinance is adopted eliminating small project <br /> exemptions and the Amador Valley Savings and Loan <br /> project does not receive small project approval, his <br /> offer to complete the northerly end of Bernal Avenue <br /> extension is void; and <br /> <br /> WHEREAS, after conference with the City Attorney, it was <br /> determined to be appropriate to exempt the Amador Valley <br /> Savings and Loan Project from the Vineyard Avenue <br /> moratorium in accordance with the terms of the draft <br /> agreement attached with the condition that the Bernal <br /> Avenue extension be completed; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> Section 1: The Vineyard Avenue moratorium is lifted regarding <br /> the Amador Valley Savings and Loan property only with <br /> the requirement that the developer enter into the draft <br /> contract (attached) committing it to put in the <br /> northerly end of the Bernal Avenue extension. <br /> <br /> Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> THIS RESOLUTION ADOPTED SEPTEMBER 1, 1987 BY THE FOLLOWING VOTE: <br /> <br /> AYES: Councilmembers - Wilson and Vice Mayor Mohr <br /> NOES: Councilmember Brandes <br /> ABSENT: None ~H <br /> e~ R] Walker,' City Clerk ' <br /> Doris George, Deputy City Clerk <br /> <br /> · MacDonaidj3 City~Attorney <br /> <br /> <br />
