The roll call vote was as follows: <br />AYES: Councilmembers - Ayala, Brozosky, Campbell, Hosterman, and Mayor Pico <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> It was moved by Ms. Hosterman, seconded by Mayor Pico, to adopt Resolution No. <br />03-093, directing staff to prepare a resolution and letter to Pleasanton's Congressional <br />representatives supporting law enforcement efforts against terrorism and asking <br />Congressional representatives to monitor the implementation of the Patriot Act and <br />actively work for the repeal of those acts and orders that violate fundamental rights and <br />Hberties enumerated in the U.S. Constitution. <br /> <br /> Mr. Brozosky said a resolution like that should not be limited to the Patriot Act. He <br />supported the Constitution and there are many laws that could be considered unconstitutional, <br />such as the under age drinking ordinance previously mentioned. He did not want the police to <br />have more power than the people have. He has not read the Patriot Act and is not ready to <br />comment on it. It is federal legislation and people have been elected to represent the citizens at <br />that level. He did not want to abuse power at the City level by trying to overrule the <br /> <br /> Ms. Ayala applauded the Library Commission for doing the research and taking the time <br />to deal with this. <br /> <br /> Mr. Campbell asked if the action in Option 2 was germaine to the agenda item. He felt <br />that was a separate issue. <br /> <br /> Mr. Roush said the agenda item was in reference to the Patriot Act's application to the <br />library operations. However, the staff report did talk about additional steps other communities <br />have taken, locally and statewide and did provide backup information that addressed that. He <br />believed the staff report covered it and option 2 would be under the umbrella of what is on the <br />agenda. <br /> <br />Mr. Campbell asked how much staff time would be devoted to writing the letter. <br /> <br />Mr. Roush said there would not be much staff time to merely write a letter. <br /> <br />Ms. Ayala felt taking an action beyond the subject of the agenda is inappropriate. <br /> <br /> Mr. Brozosky felt that many people agreed with the Library Commission <br />recommendation, but if they knew Council was discussing the whole Patriot Act, there might <br />have been more people to testify. <br /> <br /> Mayor Pico felt option 2 was pretty generic and basically asked the representatives to <br />monitor the Act and to work to repeal acts that violate the Constitution.
