Mr. Brozosky said this ordinance would allow the police to cite them, which <br />mean the police have to identify them. <br /> <br /> Chief Neal said that is correct. It is an infraction, at the lowest level of the <br />statutes they can create. It is not meant to be punitive. It is meant to give the police the <br />ability to identify the students, notify their parents with what they are involved in, and in <br />the worse case, it does carry sanctions, just like any of the police department <br />administrative citations, with a sequential fine of $100 for the first offense; $250 for <br />second offense; and $500 for third offense. <br /> <br />Mr. Brozosky asked what the common procedure would be. <br /> <br /> Chief Neal said the common procedure for youth residing in Pleasanton. It is <br />unfortunate that we restrict the minor offense court to kids that reside in Pleasanton only <br />just to manage the workload. It is mn by volunteers of licensed therapists the volunteer <br />their time and candidly any sanctions that come out of that, any follow-up of 30 - 60 - 90 <br />day follow up with the child involved in a criminal activity Is much easier to manage in <br />the City of Pleasanton than a child from another nearby city. Those first time offenders <br />in Pleasanton would be diverted into our minor offense court system. Those who do not, <br />the infraction would simply go to the juvenile traffic commissioner, much like the traffic <br />citation. The common denominator is that you cannot get around this without your <br />parents finding out what you were engaged in, whether you live in Pleasanton or another <br />city. <br /> <br /> Mr. Brozosky asked if there was any to modify this at the first offense that the <br />parents get called and they would have to come and pick up their child. <br /> <br /> ChiefNeal said the parent would have to come and pick up their child. They are <br />released on what is a "notice to appear" citation. A parent or close relative has to respond <br />to pick up the child, and co-sign the notice to appear promising to bring the child to a <br />court appearance. When they are diverted they are sent a letter indicating they have been <br />selected to be diverted into the minor offense court process. This minor offense court <br />process takes place and the criminal court process stops. <br /> <br /> Ms. Hosterman said it is imperative that Council does everything they can to <br />support the police department in maintaining health and safety in the community. She <br />thanked ChiefNeal for doing such a good job at this. She also recognized that there is a <br />problem in the community with teen-aged drinking in homes and apparently sometimes <br />unaccompanied. However, that is not included in the staff report, and she is very <br />concerned about approving ordinances which come really close when it comes to talking <br />about the state's interest in going into someone's home with the fundamental right to <br />privacy in ones home. She felt the City was going a little too far in this. She also asked <br />(1) could Chief Neal give the history of the calls the department has made that fall into <br />this type of call and how it was resolved, what is the nature of the resolution.
