Ms. Michelotfi agreed with those remarks. The hearing is about the total use of the
property and the sooner that is determined and it is know that a bar use would be gone, then the
easier it would be for someone to come forward with an application that is in compliance with
the allowed uses.

A substitute motion was made by Ms. Michelotti, seconded by Ms. Dennis, to
schedule the revocation hearing on December 17, 2002.

Mr. Campbell believed Council should honor its original agreement for review in
January.

Ms. McKeehan indicated that the feeling was that if there were problems Council would
want to hear about it sooner rather than later and a review was scheduled for November.

Ms. Michelotti felt that it was far better to know early in the process whether this use
would be p~mdtted on this property. The property owner would then know, when dealing with
prospective tenants, what uses would be allowed there.

Mayor Pico believed the owner is aware of what is happening with this property.

Ms. Dennis said if this were any other application, she would agree that January was
acceptable. However, she was concerned about having the bar open during the holidays and was
concerned something bad may happen. She did not want to keep this issue going any longer than
absolutely necessary.

Mayor Pico pointed out that even if the matter were scheduled for December 17, it could
be continued to January.

Ms. Michelotti said there had been ongoing problems reported at the last heating and
Council was advised that this may all go away at the end of November. She had been counting
on that and she could not accept letting the situation go until mid-January.

The roll call vote was as follows:
AYES: Councilmembers - Ayala, Dennis, and Michelotti
NOES: Councilmember Campbell and Mayor Pico
ABSENT: None
ABSTAIN: None

Item 6e
City Policy for connection to sewer and water services in the Happy Valley Area.
(SR 02:276)

Philip Grubstick presented the staffreport.

Pleasanton City Council 27 11/19/02
Minutes
