Mr. Campbell referred to the increase in security guards and asked if all sixteen guards
were present on a Saturday night patrolling the area, or does that mean there are sixteen guards
on the payroll.

Mr. Ratinho said they were all present on Saturday.

Mr. Campbell asked if he felt he had an obligation to work with the existing
neighborhood.

Mr. Ratinho said yes.

Mr. Campbell asked he had a responsibility to control the patrons in the parking lot after
his businesses closes to make sure the noise complaints are alleviated or non-existent.

Mr. Ratinho said yes. 90% of the job of the security guards occurs after the club closes.
Inside the club, there are no problems. He believed they have to do everything possible to
disperse the patrons. They have put up signs, handed out flyers, etc. to keep the noise down.

Mr. Campbell said the business was most successful when it had hip hop music and the
business has gone down 60% since it changed to top 40 hits. The question is if you are allowed
to continue in business, will you go back to the hip hop format to make more money. He asked
if Mr. Ratinho was sincere in wanting to make changes.

Mr. Ratinho said he planned to stay with the top 40 format, especially with the
information that Shabooms is closing for renovations. He felt those patrons will look for
somewhere else to go.

Ms. Ayala thought he was converting to a Mountain Mike's Pizza with only the back half
for dancing. She asked what the occupancy was for the back half.

Mr. Ratinho said he was going to use only the back half and the occupancy was 250-275.

Ms. Ayala asked how he could have that same occupancy in half the space?

Mr. Ratinho said he had to talk to the Planning Department and Building Department to
see what the actual allowed occupancy would be. His current capacity is 400.

Ms. Ayala was confused about an incident in the video tape when it appeared someone
was being arrested.

Mr. Ratinho did not think anyone was being arrested. He said he just filmed the police
going through his parking lot. He felt at that point in time that he was being targeted and the
point of the tape was to show the people leaving the parking lot in an orderly manner and that the
noise did not exceed noise levels in the ordinance.

Pleasanton City Council 11 09/03/02
Minutes
