June Perry, 1300 Ptarmigan Drive #5, Walnut Creek, indicated she has known Mr. <br />Ciesielski since she was his teacher at Arnador Valley High School. She was pleased to see how <br />he has restored his grandmother's house. She believed that previous comments about his <br />personal finances were an invasion of privacy. She said Mr. Ciesielski has a business dealing <br />with authentic miniature soldiers. Just because he does not leave at nine in the morning and <br />come back at 5:30 p.m. does not mean he does not have a job. <br /> <br /> Ken Habiger, 5109 Marita Drive, Antioch, indicated he has done a lot of work on Mr. <br />Ciesielski's house and has done a lot of work to get City permits. The City did not allow him to <br />do many of the things Mr. Ciesielski wanted, such as a second story or a brick fireplace. They <br />complied with all the City regulations. He has followed this situation with disbelief. He <br />believed the only logical use for this property is to return it to the Ciesielski family. He would <br />like Council to make a decision tonight. <br /> <br />There being no further speakers, the public hearing was closed. <br /> <br /> Mayor Pico asked the Councilmembers if anyone who had voted to declare the property <br />surplus wanted to reconsider the sale of this property. No one wanted to. <br /> <br /> It was moved by Ms. Dennis to approve the original Purchase and Sale Agreement <br />with the new closing date. <br /> <br />The motion failed for lack of a second. <br /> <br />Mr. Campbell asked for clarification of the differences between the two agreements. <br /> <br /> Mr. Roush indicated the original agreement provided that Mr. Ciesielski would make a <br />down payment of 20% and the remainder would be paid over a seven-year period. <br /> <br />Ms. Michelotti pointed out that Mr. Ciesielski was willing to sign the second agreement. <br /> <br /> Ms. Ayala said the first agreement basically gave Mr. Ciesielski a loan. She did not want <br />the City to act as a financial institution. She was adamantly opposed to giving a loan and was <br />much more comfortable with the second agreement requiring a cash payment. <br /> <br /> It was moved by Ms. Michelotti, seconded by Ms. Dennis, to adopt Resolution No. <br />02-022, approving the Revised Purchase Agreement. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers - Campbell, Dennis and Michelotti <br />NOES: Councilmember Ayala and Mayor Pico <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Pleasanton City Council 8 02/19/02 <br />Minutes <br /> <br /> <br />
