Ms. Ayala said that just because Mayor Pico and Ms. Michelotti cannot vote on the issue, <br />they can still exert some influence on the rest of the Council. <br /> <br /> Mr. Roush clarified they could address Council as property owners, however they could <br />not 'qobby" Council. <br /> <br /> Mr. Pico believed Councilmembers were prohibited from influencing the decision, which <br />is why he and Ms. Michelotti leave the Chambers during the discussion. He wanted to protect <br />the process from future legal challenges to the validity of the Specific Plan. He also pointed out <br />that in the future when specific portions of the Plan come before Council for approval, he and <br />Ms. Michelotti could participate in the decision making process so long as the issues were farther <br />than 500 feet from their prope~ies. <br /> <br />6. PUBLIC HEARINGS AND OTHER MATTERS <br /> <br />Item 6a <br />Revised Purchase Agreement Concerning Surplus Proper .ty on Stanley Boulevard <br />(SR 02:047) <br /> <br /> Mr. Roush presented the staff report. <br /> <br /> Ms. Dennis asked if the only difference between the original Purchase and Sale <br />Agreement and the one before Council now was the terms of payment? <br /> <br /> Mr. Roush said that was correct and there was also a difference in the closing date. <br /> Ms. Ayala asked if Mr. Ciesielski had signed the new agreement? <br /> <br /> Mr. Roush indicated that Mr. Ciesielski's attorney has indicated Mr. Ciesielski is willing <br />to sign the agreement and Mr. Roush had no reason to think otherwise. <br /> <br /> Ms. Michelotti clarified that there would be no building on this property in the future. <br /> <br /> Mr. Roush explained that the Ciesielski and City lot would be merged as one lot and <br />there is a condition that no habitable building would be allowed on the existing City parcel.. <br />Any structure, even a tool shed, would have to have Planning Department approval. <br /> <br /> Mr. Campbell asked how the lawsuit affected the Purchase and Sale Agreement? <br /> <br /> Mr. Roush said that Mr. Ciesielski can wait until the litigation is over before he closes <br />escrow. <br /> <br /> Mayor Pico asked if the City was named as a party to the litigation. <br /> <br />Pleasanton City Council 4 02/19/02 <br />Minutes <br /> <br /> <br />
