A substitute motion was made by Ms. Michelotti, seconded by Ms. Ayala, to have <br />open fencing with shrubs to the drip line of the oak tree and to allow solid fencing the rest <br />of the way. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Ayala and Michelotti <br />NOES: Councilmembers Campbell, Dennis, and Mayor Pico <br />ABSENT: None <br />ABSTAIN: None <br /> <br />The motion failed. <br /> <br /> Ms. Ayala was very upset at the situation that had arisen in this development. The PUD <br />required open fencing and solid fences should never have been allowed. She was sorry the Lu's <br />had bought the house without knowing the full situation. She referred to three panels of fencing <br />that are missing lattice and felt that also makes it look incomplete. She felt there should have <br />been some disclosure from the prior owner or the realtor. <br /> <br />Ms. Michelotti inquired how the drip line would be measured. <br /> <br /> Mr. Swil~ said staff was clear on the direction and could determine the location of the <br />fence. <br /> <br /> Ms. Michelotti asked if the original motion could be amended to include removing the <br />three panels of solid fencing that are missing the lattice (24 feet). <br /> <br /> It was moved by Ms. Dennis, seconded by Mayor Pico, to introduce Ordinance No. <br />1831, to be read by title only and waiving further reading thereof, approving a major <br />modification to PUD-88-16 to allow the retention of a solid privacy fence along a portion of <br />the rear property line of an existing residence, with the three panels of the existing fence <br />which do not have lattice on top to be removed and replaced with open fencing and <br />landscaping. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers - Ayala, Campbell, Dennis, Michelotti, and Mayor Pico <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Pleasanton City Council 8 05/15/01 <br />Minutes <br /> <br /> <br />
