Mike Fuller, 4120 Foothill Road, father of the applicant, indicated concurrence with the
staff recommendation.

Mr. Campbell inquired about the trail plan and the raptor nest.

Mr. Fuller said there is a trail easement providing access to the top of the ridge and they
agreed to that. Mr. Fuller did not know what a raptor looked like but did not think there were
any nests.

Mr. Swift explained the requirement is that the area be surveyed at the time of year when
a nest would be likely. The condition would require that people stay a certain distance from any
nest during construction. When the Fradeses are ready to build their house, if it is during the
season, then a survey would be done to make certain raptor nests were not interfered with.

Mr. Fuller agreed with the condition. He also felt that since the property already had
structures and active ranching for about eighty years, it is not likely there would be any raptors in
the area.

There being no further speakers, the public hearing was closed.

It was moved by Ms. Ayala, seconded by Ms. Dennis, to adopt Resolution No.
01-039, approving the negative declaration for this project.

The roll call vote was as follows:
AYES: Councilmembers - Ayala, Campbell, and Dennis
NOES: Mayor Pico
ABSENT: Councilmember Michelotti
ABSTAIN: None

It was moved by Ms. Ayala, seconded by Ms. Dennis, to introduce Ordinance No.
1830, to be read by title only and waiving further reading thereof, approving the
application of Clay and Schelly Frades (Case PUD-03) for PUD development plan approval
to subdivide an existing 77.5 acre parcel located at 4120 Foothill Road into three parcels
measuring approximately 61.16 acres, 11.22 acres, and 5.09 acres, with the 61.16-acre
parcel containing an existing single-family dwelling, two existing secondary units, and two
existing garages/storage barns; the ll.22-acre parcel to have a new home of 6,500 square
feet; and the 5.09-acre parcel to have a new 4,680 square foot, two story home constructed
on it.

The roll call vote was as follows:
AYES: Councilmembers - Ayala, Campbell, and Dennis
NOES: Mayor Pico
ABSENT: Councilmember Michelotti
ABSTAIN: None

Pleasanton City Council 12
Minutes

05/08/01
