She asked for questions <br />from Mr. Campbell on what his concerns were. <br /> <br /> Mayor Pico did not think a major dialogue on this issue was necessary. He did <br />share her concerns. There is a major commitment to the neighbors on this and he felt this <br />was all linked together. He was not in favor of the appeal. <br /> <br /> Ms. Dennis was also involved in this and talked to people on Independence. She <br />felt they negotiated well for themselves and got a project they could live with. In reading <br />the Planning Commission minutes, the primary issues were getting the project they <br />wanted, not a linkage to the annexation. She visited the residents nearby and took <br />pictures of impacts that have been caused by the Greenbriar development. She presented <br />those to Council. She did not think Council was being fair to all Pleasanton residents. <br />The people on the other side of this project have more impacts than those on Sycamore. <br />The drainage issues are substantial if the New Cities project is not completed. Even if the <br />annexation does not occur; that the condition could be permanent concerns her. People <br />have paid for a lot and still have no water or sewer. To let this project lapse means these <br />people may have to renegotiate agreements under less favorable circumstances. She did <br />not feel the linkage to annexation was major. It was an afterthought. Linking the project <br />and getting the permits could help the golf course project. If annexation does not proceed <br />and the New Cities approval lapses, there will be permanent affects on the residents. <br />There is a fear there will be no project if the annexation is not approved. <br /> <br /> Ms. Ayala said these are impacts caused by Greenbriar, not New Cities, and it is <br />G-reenbriar's problem. <br /> <br /> Ms. Dennis said the Greenbriar project stops and the road improvements stop at <br />the edge of the New Cities project area. It is not Greenbriar's responsibility to deal with <br />land that is not part of its project. <br /> <br /> Ms. Michelotti came to the Planning Commission in 1985 and saw the North <br />Sycamore property developed and annexed. She worked with the neighbors in Ventana <br />Hills who finally approved this project. Tying this to the Happy Valley annexation was <br />never discussed. That only happened on the night the Council took action on the project. <br /> <br /> Mr. Campbell asked for an explanation of nexus and why conditions are put on <br />projects in the first place. <br /> <br /> Mr. Roush said nexus is a legal term that indicates there is a relationship between <br />a condition and the impact that the project will cause. In other words, ifa governing <br />body imposes a condition with no nexus, a court could say the condition is not valid. <br /> <br /> Mr. Swift said there are many conditions for many reasons. In a development <br />plan you can't incorporate all the things you want a project to do by what it looks like on <br />a piece of paper.
