He referred to problems with New Cities on another development in Pleasanton <br />and wanted to know what that litigation was about. <br /> <br /> Mr. Roush said the litigation had to do with an access easement and whether it <br />should be put in as part of the development. The City felt the developer should be <br />responsible. The matter was settled out of court with the cost of the easement split 50/50. <br /> <br /> Margo Layton, 42425 Mission Boulevard, Fremont, said she was planning to <br />purchase a lot adjacent to the New Cities development and move to Pleasanton. She felt <br />this project would be an asset to the City and the project fits into the overall plan. She <br />did not see why annexation should be tied to it. Her lot is on Sycamore and in order for <br />her to get water and sewer; New Cities needs to proceed with the project. She felt Mr. <br />Bates has worked hard to accommodate the concerns of the neighbors. <br /> <br /> Deon Bringhurst, 990 Sycamore (41646 Covington Drive, Fremont), father of Ms. <br />Layton, understood the infrastructure had to be in place before he could build on his lot. <br />He did not understand why this is taking so long and or the nexus of developing this <br />project with the annexation. New Cities has always committed to funding the <br />infrastructure. He has been amazed at the impacts some of the neighbors have had on <br />getting lot line adjustments, etc. He felt it was time to move forward with this. <br /> <br />Ms. Dennis asked if his property was in the city. <br /> <br />He said yes. <br /> <br /> Frankie Lau, 1105 Lund Ranch Road, objected to any modification to the original <br />approval. It takes a while for neighbors and developers to come to agreement and he did <br />not want changes now. If changes are allowed now, it was a waste of all our time before. <br />Citizens deserve a better quality of life. He expressed concerns about traffic problems <br />and the crowded schools. <br /> <br /> Jean Kass, 966 Sycamore Road, had a lot of concem about halting this project. <br />Her main concern is about the sewers. She was available to talk to Councilmembers and <br />show them around her property. She saw no reason for further delay. <br /> <br />Ms. Michelotti referred to her letter and the impacts on her property. <br /> <br /> Ms. Kass has not been able to determine her street address. There is a gap in <br />Sunset Creek Road; there are questions about access from the project to North Sycamore <br />Road. She has been in Pleasanton since 1967 and has watched the meetings. She felt <br /> New Cities has done everything it can.
