CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-178 <br /> <br /> RESOLUTION APPROVING PREANNEXATION AND WATER <br /> SERVICE CONNECTION FOR PROPERTY OF DIANE HABENER <br /> <br />WHEREAS, Diane Habener requested city water and sewer <br /> services to serve her 0.96 acre lot on the <br /> northwest corner of Linden Way and Vine Street; <br /> and <br /> <br />WHEREAS, Council considered the application at its meeting <br /> of April 19, 1988 and found that the unique <br /> circumstances of the Habener's parcel justify this <br /> exception from normal policy; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Council has considered the unique aspects of this <br /> property and makes the following findings based on <br /> these unique considerations: <br /> <br /> 1. The City water system on the adjacent property <br /> has been in place for over twenty years but <br /> remains under Alameda County jurisdiction. <br /> <br /> 2. The property is immediately adjacent to an <br /> existing City water system. <br /> <br /> 3. The adjacent property was extended City water <br /> without requiring annexation. <br /> <br />Section 2: Approves the request of Diane Habener to connect <br /> to the City Water System only and approves a <br /> Preannexation Agreement for the Habener property <br /> (0.95 acre) located on the northeast corner of <br /> Linden Way and Vine Street, which requires the <br /> applicant to pay all expenses associated with the <br /> water hook-up. <br /> <br />Section 3: Authorizes the appropriate city officials to <br /> execute the Preannexation Agreement. <br /> <br />Section 4: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br /> <br />
