comfortable that all the work is actually being done and did not know how to verify that. <br />She was also concerned that the homeowners association is not aware of what it is getting <br />into. <br /> <br />Mayor Tarver also had doubts about the homeowners association. <br /> <br /> Ms. Dennis indicated that is why firms like LSA are hired to monitor mitigation <br />programs. Signature Properties is responsible for constructing the habitat and weftands, <br />not the homeowners association. <br /> <br /> Ms. Lutz said that is true, but the homeowners association is responsible for <br />maintcrmnce. <br /> <br /> Mayor Tarver asked if the estimate in the budget of the homeowners association <br />is sufficient to handle its responsibilities. <br /> <br /> Ms. Seto explained that the homeowners association is required to provide annual <br />reports on the tiger salamander. Signature Properties has provided funding to pay for the <br />reports. It is estimated to cost $5,000 per year and Signature has provided $10,000 for <br />the costs. There is also a $45,000 contingency fund in the event any type of maintenance <br />work is required. The wetlands maintenance for the first five years is to be done by <br />Signature Properties. Any costs would be borne by Signature Properties and that is <br />covered by a cash deposit with the City- of Pleasanton. <br /> <br /> Ms. Michelotti said thc homeowners association will not have to pay for the <br />annual reports because the funds are in the bank. It just has to provide the reports. <br /> <br />Mayor Tarver asked what mitigations would be covered by the $45,000? <br /> <br /> Ms. Seto said there is a contingency fund in the event the report requires extra <br />work. Signature Properties is responsible for the on-going maintenance. <br /> <br /> Mr. S~vift indicated the Ruby Hill Homeowners Association is not the usual small <br />homeowners association that maintains a pool or some common area. It is responsible <br />for the roads in the entire subdivision, acres of landscaping, a ten-acre park, the pool, <br />cabana club, and the habitat area. The habitat is a very small mount of the total on- <br />going expense of this association. <br /> <br /> Ms. Lutz presented a copy of her presentation and a map of the ponds. She said <br />Fish and Game is very interested in this project and she has been in communication with <br />the Dcpar[mcnt for over a year, but people keep changing jobs and the new people have <br />to start from the beginning. <br /> <br /> Jim McKeehan, Vice President and General Counsel for Signature Properties, did <br />not believe it was complicatad to understand the environmental permits that are required. <br />A 404 permit was obtained from the Army Corps of Engineers for the wetlands property. <br /> <br />Pleasanton City Council 8 05/02/00 <br />Minutes <br /> <br /> <br />
