He believed one way to <br />accomplish a review of the building and make some modifications to the design of the <br />building is to direct stdit'to make changes pursuant to a minor modification process. <br />Council could have it on the next agenda and direct staff to make minor changes. The <br />only other altemative is to initiate a major change and go through the public heating <br />process, which would take almost two months. <br /> <br /> Ms. Micheloiti reiterated the developer is willing to work with staff on minor <br />ctmnges. <br /> <br /> Mr. Slajchert indicated he would be happy to make minor changes so long as the <br />project stays within its approval. He said a hearing was held before the Housing <br />Commission on March 16 and comments were made about the rear landscaping. He said <br />there is flexibility to make the necessary modifications and he is more than willing to do <br />that. The focus is to retain the existing approved development in a form that would allow <br />them to maintain the design and application for the tax credits. That is a very competitive <br />process and there is limited flexibility to make changes prior to the next round. From a <br />financial standpoint, his company cannot keep this property trader contract after the next <br />round. They must close on the property by the end of the year or not move on the project <br />at all. The project approval counts as 25 points and 140-150 points are necessary to have <br />a good chance of getting funding. At this point, his project is in that range, but if it loses <br />25 points, it would take them out of competition. <br /> <br /> Ms. Ayala asked if the developer could just work with staff to implement the <br />changes that were discussed at the workshop and the Planning Comntission meeting so <br />long as it did not become a minor or major modification. <br /> <br /> Mr. Swift said if the changes were just about landscaping, that would be no <br />problem. If the discussion is to eliminate a fire mad. that is in the approval and would <br />require a major change. <br /> <br /> Ms. Dennis felt Council had responsibility for this. It knew when the rental <br />lhcility was denied that the o~gixml approved project would stand. There has been a big <br />sign on the proper~y and if Council did not agree with that prior approval, it had the <br />ability to change it before now. <br /> <br /> Ms. Ayala asked for a visual montage for the view fi'om Foothill ~vhen it is <br />available. <br /> <br />Mayor Tarvet indicated there were not three votes to add the item to the agenda. <br /> <br />Mr. Slajchert indicated he would provide any information the Council would like. <br /> <br /> Mr. Swift asked Council to advise staffof any minor changes it might like to <br />make on this. <br /> <br />Pleasanton City Council 27 05/02/00 <br />Minutes <br /> <br /> <br />
