elevator pit size. Those drawings started in 1995. He was required to put up a 90 foot <br />retaining wall along Main Street and every seven feet a 25 foot 'T' beam was put in. <br />That was a change required by the Building Department after he had submitted his <br />original foundation only drawings. During that time, he did not think about the elevator. <br />It had been approved by a City Inspector in March 1997 and it was built. <br /> <br /> Mayor Tarver indicated part of the problem is the length of time it took to <br />construct the building and the number of plans that have been submitted. In 1995, when <br />the elevator was put in, did the plans show any use on the second floor? <br /> <br />Mr. Churka said the City required the building to be two stories. <br /> <br /> Ms. Michelotti said plans were submitted for a two story building, but the use was <br />only on the first floor, because Mr. Churka said there would be no use on the second <br />floor; it was for storage only. <br /> <br />Mr. Churka agreed that at that time that was correct. <br /> <br /> Ms. Michelotti further stated the elevator was for access to storage only at that <br />time. <br /> <br /> Mr. Churka agreed the elevator was for freight, but he said it would eventually be <br />turned over to passenger use. He believed the 1991 Code allowed that. <br /> <br /> Ms. Michelotti reiterated he only had approval to build a building with no second <br />floor use. <br /> <br /> Mr. Churka said the City required a two story building. He did not have the funds <br />to build out the second floor at that time. There is now 3200 square feet of space and that <br />is a heck of an attic. The space was designed so he would not have to remove the roof, <br />add another floor, redesign the building, and hold down business on the first floor. He <br />called it an attic at the time so he would not have to submit more drawings to the <br />Building Department to designate its use. He put in the elevator to the second floor <br />because he knew it would have to be used eventually. <br /> <br /> Mayor Tarver said the point he was trying to make was that when the building <br />was originally conceived and the plan checking was done, it was not understood that Mr. <br />Churka was intending to put a retail establishment on the second floor. When staff <br />reviewed the plans, the elevator was fine for the use stated. <br /> <br />Mr. Churka said he put up a sign saying office space only for lease. <br /> <br /> Ms. Ayala asked if there were plans submitted to the City for that use when he put <br />up the sign? <br /> <br />Pleasanton City Council 11 04/04/00 <br />Minutes <br /> <br /> <br />
