Mr. Swift said it was finn to the extent that this is what staff will tell proposed <br />bidders that their projects must include. The existing PUD allows five stories and the <br />Planning Commission recommended four stories. <br /> <br /> Mr. Pico was willing to proceed with Exhibit A as written. This could be debated <br />all night and he was comfortable that staff had done a good job getting mutual agreement. <br /> <br /> It was moved by Mr. Pico, seconded by Ms. Michelotti, to adopt Resolution <br />No. 00-010, endorsing the Term Sheet and authorizing staff to prepare a Purchase <br />and Sale Agreement. <br />The roll call vote was as follows: <br />AYES: Councilmembers - Ayala, Michelotti, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: Councilmember Dennis <br />ABSTAIN: None <br /> <br /> Mr. Pico suggested accepting staff recommendations I and 2 regarding the Task <br />Force recommendations and that the wording conceming the use of the bond proceeds <br />not be revised. <br /> <br /> Ms. Ayala asked if Mr. Pico would include the parenthetical phrase (after ten <br />years) relative to retiring the bond debt. <br /> <br />Mr. Pico clarified that his motion was not to use funds off-site. <br /> <br />Ms. Michelotti indicated she had some wording changes to suggest. <br /> <br /> Ms. Ayala had no problem with the recommendations, just the wording of the use <br />of the proceeds. She wanted the "(after ten years)" included. <br /> <br /> Mr. Pico said he would be willing to adopt staff recommendations 1, 2 and 3 as <br />long as the wording "or adjacent to the site to mitigate impacts caused by development of <br />the site; provided, however, that the proceeds may be used to finance public facilities or <br />infrastructure not related to the site if so approved by the voters" was deleted, but he <br />agreed to add the phrase "after ten years". <br /> <br /> Ms. Michelotti suggested that "in the future proceeds may be used to finance <br />public facilities or infrastructure not related to the site only if so directed by a majority <br />vote of the people." <br /> <br />Mr. Pico did not want to include that language. <br /> <br /> Ms. Rossi said that staff' s recommendation to include the voter provision was <br />based on the recommendation of the City's bond counsel. His concern was that if for any <br />reason the community wanted to do something, this has taken that control from the <br />community, not just a future Council, and given it to bond holders.
