CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 88-175 <br /> <br /> RESOLUTION RESCINDING ORDINANCE NO. 1349, APPROVAL <br /> OF THE APPLICATION OF TIOGA CONSTRUCTION <br /> CORPORATION FOR A PLANNED UNIT DEVELOPMENT REZONING <br /> AND DEVELOPMENT PLAN APPROVAL FOR A MIXED-USE <br /> COMMERCIAL COMPLEX TO BE LOCATED AT THE SOUTHEAST <br /> CORNER OF THE INTERSECTION OF SANTA RITA ROAD AND <br /> PIMLICO DRIVE (PUD-80-15-5D) <br /> <br />WHEREAS, on February 16, 1988, Council adopted Ordinance No. <br /> 1349, approving a service station and minimart at <br /> the intersection of Santa Rita Road and Pimlico <br /> Drive; and <br /> <br />WHEREAS, due to concerns of nearby residents a referendum <br /> petition was circulated; and <br /> <br />WHEREAS, the referendum petition has qualified for the <br /> ballot in that it contains valid signatures of more <br /> than ten percent of the voters of the City of <br /> Pleasanton according to the County Clerk's last <br /> official report of registration to the Secretary of <br /> State; and <br /> <br />WHEREAS, at its meeting of April 19, 1988, Council <br /> considered whether to submit the referendum to the <br /> voters or to rescind the ordinance; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council hereby rescinds Ordinance No. <br /> 1349, which approved the application of Tioga <br /> Construction Corporation for planned unit <br /> development rezoning and development plan approval <br /> for a mixed-use commercial complex to be located at <br /> the southeast corner of the intersection of Santa <br /> Rita Road and Pimlico Drive (PUD-80-15-5D). <br /> <br />Section 2: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br /> <br />
