Mayor Tarver did not want to promise anyone anything. This is the part that has <br />to be done in such a way that there is no question about what the agreement says and <br />what the chances of approval are. This is not a guarantee. He preferred to spell out to the <br />people in the Happy Valley area what they can expect from a project on the Spotorno <br />property to be. After November 2, that decision is made and the annexation vote is after <br />the decision on the CAPP Initiative. If CAPP applies and there is no development <br />agreement with the Spotornos, that introduces another level of uncertainty with the <br />annexation vote. If there is development approval of some limited time period with <br />known conditions, there is still uncertainty. If the Spotornos don't perform in the time <br />required, there is nothing. <br /> <br /> Ms. Ayala objected to Council trying to jump through all these hoops prior to the <br />CAPP Initiative. If the decisions were to ease someone's mind for annexation, she would <br />support it, but all this discussion is about how to beat CAPP. <br /> <br />Ms. Michelotti felt this was in aid of the Happy Valley annexation. <br /> <br /> Mayor Tarver felt this decision could be made on November 9th and indicated he <br />would support the motion to consider a development agreement with the Spotornos and <br />staff can work out the details. It will be on the November 9th agenda and we will know <br />how the CAPP Initiative will affect this. He wants a fool-proof agreement with some <br />specificity. <br /> <br /> It was moved by Ms. Michelotti, seconded by Ms. Dennis, to reconsider a <br />development agreement with the Spotornos on November 9. <br />The roll call vote was as follows: <br />AYES: Councilmembers Ayala, Dennis, Michelotti and Mayor Tarver <br />NOES: None <br />ABSENT: Councilmember Pico <br />ABSTAIN: None <br /> <br />8.
