6. PUBLIC HEARINGS AND OTHER MATTERS Item 6a PAP-II Appeal of the Planning Commission's denial of the appeal of the approved landscaping plan for the residence located at 417 Sycamore Road. (SR 99:004) Ms. Ayala indicated she would like to hold the public hearing and make a decision at this meeting. It was moved by Ms. Ayala to hold the public hearing and make a decision tonight. The motion died for lack of a second. Ms. Michelotti wanted to allow people who could not come to the next Council meeting to be able to give their testimony in the event this item was continued. Ms. Dennis did not want to decide whether to continue the item until after the public hearing. Mayor Tarver said this item is before Council on appeal and he did not want to make a decision unless the appellant was present. Council can indicate no further continuances would be granted. It was moved by Ms. Michelotti, seconded by Ms. Dennis, to open the public hearing. The roll call vote was as follows: AYES: Councilmembers - Ayala, Dennis, Michelotti, Pico, and Mayor Tarver NOES: None ABSENT: None ABSTAIN: None Brian Swift presented the staff report. Ms. Ayala asked who continued the hearing to this date. Mr. Swift indicated staff had requested it with the consent of both parties because of the number of items that had been on the previous agenda. Mayor Tarver declared the public hearing open. Jack Keane, 417 Sycamore Road, indicated this matter has been going on for three years and he would like a decision from Council at this meeting. The appellant has already stated his case before the Planning Commission but left before the Keanes presented their case and before the Planning Commission commented. He indicated Mr. Dingman has made life miserable for the Keane family and cited various incidents. Mr. Keane indicated Mr. Dingman already has trees and a roof to cover his hot tub.
