6. PUBLIC HEARINGS AND OTHER MATTERS <br /> <br />Item 6a <br />PAP-II Appeal of the Planning Commission's denial of the appeal of the approved <br />landscaping plan for the residence located at 417 Sycamore Road. (SR 99:004) <br /> <br /> Ms. Ayala indicated she would like to hold the public hearing and make a <br />decision at this meeting. <br /> <br /> It was moved by Ms. Ayala to hold the public hearing and make a decision <br />tonight. The motion died for lack of a second. <br /> <br /> Ms. Michelotti wanted to allow people who could not come to the next Council <br />meeting to be able to give their testimony in the event this item was continued. <br /> <br /> Ms. Dennis did not want to decide whether to continue the item until after the <br />public hearing. <br /> <br /> Mayor Tarver said this item is before Council on appeal and he did not want to <br />make a decision unless the appellant was present. Council can indicate no further <br />continuances would be granted. <br /> <br /> It was moved by Ms. Michelotti, seconded by Ms. Dennis, to open the public <br />hearing. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers - Ayala, Dennis, Michelotti, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Brian Swift presented the staff report. <br /> <br />Ms. Ayala asked who continued the hearing to this date. <br /> <br /> Mr. Swift indicated staff had requested it with the consent of both parties because <br />of the number of items that had been on the previous agenda. <br /> <br />Mayor Tarver declared the public hearing open. <br /> <br /> Jack Keane, 417 Sycamore Road, indicated this matter has been going on for <br />three years and he would like a decision from Council at this meeting. The appellant has <br />already stated his case before the Planning Commission but left before the Keanes <br />presented their case and before the Planning Commission commented. He indicated Mr. <br />Dingman has made life miserable for the Keane family and cited various incidents. Mr. <br />Keane indicated Mr. Dingman already has trees and a roof to cover his hot tub.
