(SR 99:329) <br /> <br />Brian Swift presented the staff report. <br /> <br /> Ms. Dennis asked if the Park and Recreation Commission had objected to having <br />an ACE train station next to the park. <br /> <br />Mr. Swirl said yes. <br /> <br />Mayor Tarver declared the public heating open. <br /> <br /> Bruce Lymburn. representing the City and County of San Francisco, indicated he <br />was ready to make a presentation about the project benefits and history of negotiations <br />with the City for the development, but felt the first order of business should be the sale of <br />the property to Pleasanton. He referred to the letter to the Council from Mayor Willie <br />Brown. It is the opinion of San Francisco' s bond counsel that a ballot measure regarding <br />general obligation bonds can only go before the voters at a regular election. If the <br />deadlines cannot be met for the March 2000 election, that means November 2000 is the <br />next date available and that is not acceptable. The EIR will not longer be relevant and a <br />year will have passed since review of the project by the Boards and Commissions. Many <br />things can change in a year. <br /> <br /> Mayor Tarver indicated there are two topics, the purchase and the plan. Council <br />has been willing to have a special election on the matters and felt they both could come at <br />the same time. Does Mayor Brown want the project voted on before November 2000? <br /> <br /> Mr. Lymbum indicated a Council vote on the project should occur first. He did <br />not want a vote on the project on the same ballot with a vote on the purchase. He wanted <br />the community to know the outcome of a decision on purchasing the property. <br /> <br /> Mayor Tarver did not want to rush this process and felt that would be detrimental <br />to a successful outcome. It is possible the proposal to buy the property could fail because <br />enough time to develop an acceptable plan was not allowed. That would affect the <br />acceptance of any development proposal. If the basic purpose is to provide to the City <br />and County of San Francisco the amount of money that property can yield as quickly as <br />possible, then it is to both parties' advantage to allow time to make that happen. <br /> <br /> Mr. Lymbum said the problem is the election would have to be in November if <br />you don't make the March deadlines. <br /> <br /> Ms. Ayala asked for staff to comment. <br /> <br />Pleasanton City Council 16 <br />Minutes <br /> <br />11/09/99 <br /> <br /> <br />
