design could be improved. She was also concemed that the same kind of addition was <br />being done on several houses and preferred some variation. She agreed with some of the <br />speakers that no more c~?ress trees should be planted. <br /> <br /> Ms. Ayala referred to page 5 of the staff report where it stated the application <br />must be evaluated in accordance with the R-1-6500 zoning regulations, which do not <br />prohibit second story additions. She did not want to give architectural advice and would <br />support the application. <br /> <br /> Ms. Michelotti felt this was a difficult situation. She would not support <br />eliminating secondary structures in the City or any specific development. This <br />application is in conformance with the regulations. She thought it would be great if the <br />property owner could develop a design that was more pleasing to the neighborhood. The <br />property owner has already indicated a willingness to make concessions and to try to <br />solve the bird problem. <br /> <br /> Mr. Pico said neighborhood disputes are always the toughest decisions. He felt <br />the design of the addition could be improved. He had looked at the neighborhood and the <br />existing two story houses are well designed and blend in nicely with the single story <br />homes. He felt there was still an oppommity for the Lavers to work on the design to be <br />able to expand their home and satisfy the privacy issues in the neighborhood. Because <br />the Laver property is a comer lot, the existing proposal will stand out as a real contrast to <br />the other two story homes. He preferred that they go back and work on the design. <br /> <br /> Ms. Michelotti asked how far the addition over the garage was from the <br />neighboring properties, especially to the house behind the cypress trees. <br /> <br /> Mr. Swift said the second story over the garage would be as far as possible (about <br />80 feet) from the Sass and Sundell residences. They are both screened by the cypresses <br />as well. <br /> <br /> Mayor Tarver disliked having to decide disputes between residents. The purpose <br />of the public hearing process is to allow all parties to present their issues and try to do <br />what is right in a particular instance. He indicated he can relate to what has been <br />presented, because he has a second story addition and has a neighbor with cypress trees, <br />which he dislikes. He stated there are approved PUDs which set forth what should be <br />built in a development and where and people buy property based on what they see around <br />them. Every second story. addition needs a public hearing. The bottomline is there needs <br />to be a way of having a dispute resolution and to see if the applicant can find a way to <br />have an addition that satisfies the neighbors. He agreed that trees are important to the <br />broader issue, but Mr. Layer did not plant the existing cypresses and it is not part of the <br />issue before Council. He appreciated the surrounding neighbors' concerns and would <br />like to find a way for the Layers to get additional square footage on their house without <br />the objections of the neighbors. <br /> <br />Pleasanton City Council 8 11/02/99 <br />Minutes <br /> <br /> <br />
