COMMUMICATIONS Mr. Fales read a letter, dated June 10, 1970, from Mr. John Corley, representing ~merican Forest Products, requesting permission to lease an existing building on their property on Santa Rita Road, to a party who would like to operate a rental of hand tools, power tools, garden tools and similar equipment type of business. In his letter, Mr. Corley stated that the Planning Commission will not complete their consideration of the proposed use changes, nor will the Council be able to act upon these changes in time for this particular type of business to become profitable this summer. In his letter, Mr. Corley also requested permiss- ion of the City Council to waive the conditions of his previous letter pertaining to the use of the building and rental of hand tools, in order that American Forest Products could lease the building immediately. The letter further stated that should this be granted, American Forest agrees with the City of Pleasanton that should rental of hand tools not be a permitted or conditional use in the amendment to the Zoning Ordinance, they will not consider the use as a pre-existing use nor will they claim detrimental reliance upon the zoning ordina~ce or the proposed amendment. Mr. Fales stated that the City Attorney had reviewed this request and then called upon him for comments. Mr. Hirst advised the Council that if they grant this request, that American Forest Products be directed to include in the lease that if the City of Pleasanton deter- Dines that the rental of hand tools is not a conditional use for this location, that it will be reverted to the present state. After considerable discussion on this matter, Mr. Hirst recommended that this be referred to the Planning Commission for discussion at their meeting of June 24th. ~. Corley stated that he wished to withdraw his letter of request. CITY COUNCIL COMMITTEE REPORTS Councilman Gerton gave a detailed report on the meeting of the Bay Area Air Pollu- tion Control Board which he artended on June 10, 1970. Councilman Beratlis reported on the meeting he artended of the Valley Sand and Gravel Committee. He stated that one of the subjects of discussion was the de- watering of the gravel pits. Cpuncilman Pearson reported on the meeting he artended of the Valley Planning Committee. He reported that the East Bay Regicual Park representatives had discussed the postponement of the development of Shadow Cliff Park to sometime in January, 1971. Considerable discussion ensued regarding the water level of the gravel pits and the postponement of Shadow Cliff Park. ~TTERS INITIATED BY COUNCILMEN There were no matters initiated by Council members. ~EETING OPFN TO THE PUBLIC Mr. Victor Bailey, 4565 Black Avenue, reported on the inadequate detour routing signs during the construction of Black Avenue. Mr. Campbell advised Mr. Bailey that he would contact the construction company about this situation. JOINT STUDY SESSION WITH.
