COMMUMICATIONS <br /> Mr. Fales read a letter, dated June 10, 1970, from Mr. John Corley, representing <br /> ~merican Forest Products, requesting permission to lease an existing building <br /> on their property on Santa Rita Road, to a party who would like to operate a <br /> rental of hand tools, power tools, garden tools and similar equipment type of <br /> business. In his letter, Mr. Corley stated that the Planning Commission will <br /> not complete their consideration of the proposed use changes, nor will the Council <br /> be able to act upon these changes in time for this particular type of business <br /> to become profitable this summer. In his letter, Mr. Corley also requested permiss- <br /> ion of the City Council to waive the conditions of his previous letter pertaining <br /> to the use of the building and rental of hand tools, in order that American Forest <br /> Products could lease the building immediately. The letter further stated that <br /> should this be granted, American Forest agrees with the City of Pleasanton that <br /> should rental of hand tools not be a permitted or conditional use in the amendment <br /> to the Zoning Ordinance, they will not consider the use as a pre-existing use nor <br /> will they claim detrimental reliance upon the zoning ordina~ce or the proposed <br /> amendment. <br /> <br /> Mr. Fales stated that the City Attorney had reviewed this request and then called <br /> upon him for comments. <br /> <br />Mr. Hirst advised the Council that if they grant this request, that American Forest <br />Products be directed to include in the lease that if the City of Pleasanton deter- <br />Dines that the rental of hand tools is not a conditional use for this location, <br />that it will be reverted to the present state. <br /> <br />After considerable discussion on this matter, Mr. Hirst recommended that this <br />be referred to the Planning Commission for discussion at their meeting of June 24th. <br /> <br />~. Corley stated that he wished to withdraw his letter of request. <br /> <br /> CITY COUNCIL COMMITTEE REPORTS <br />Councilman Gerton gave a detailed report on the meeting of the Bay Area Air Pollu- <br />tion Control Board which he artended on June 10, 1970. <br /> <br />Councilman Beratlis reported on the meeting he artended of the Valley Sand and <br />Gravel Committee. He stated that one of the subjects of discussion was the de- <br />watering of the gravel pits. <br /> <br />Cpuncilman Pearson reported on the meeting he artended of the Valley Planning <br />Committee. He reported that the East Bay Regicual Park representatives had <br />discussed the postponement of the development of Shadow Cliff Park to sometime <br />in January, 1971. <br /> <br />Considerable discussion ensued regarding the water level of the gravel pits and <br />the postponement of Shadow Cliff Park. <br /> <br />~TTERS INITIATED BY COUNCILMEN <br />There were no matters initiated by Council members. <br /> <br />~EETING OPFN TO THE PUBLIC <br />Mr. Victor Bailey, 4565 Black Avenue, reported on the inadequate detour routing <br />signs during the construction of Black Avenue. <br /> <br />Mr. Campbell advised Mr. Bailey that he would contact the construction company <br />about this situation. <br /> <br />JOINT STUDY SESSION WITH. THE P~ING COMMISSION RECARDING THE PROPERTY IN THE <br />5~CINITY OF BERNAL AVE~jE AND FOGfHILL ROAD, AND_OrB~R MATTERS OF JOINT INTEREST <br /> <br />Mayor Reid recessed the meeting at 9:15 P.M. to the above Study Session. <br /> <br />l~myor Reid reconvened the meeting at 10:20 P.M. <br /> <br />EXECUTIVE SESSION REGARDING EMPLOYEE SALARY AND FRINGE BENEFIT NEGOTIATIONS <br /> <br />Mayor Reid recessed the meeting to an Executive Session at 10:21 P.M. <br /> <br />Mayor Reid reconvened the meeting at 11:00 P.M. <br /> <br /> 3. 6 -15 <br /> <br /> <br />
