Overpack from the <br />action of the Plannfnt~ Commission on December 10, 1969, granting Conditional UGe <br />Permit No. 69-12, to California-Hawaiian~Mobile Estates Inc., and Mr. J. D. Staff <br />Because of their relationship to each other, Mayor Gerton declared the piibli~ <br />hearing on the above three items, open. <br />Mr. Hirst reviewed the past action taken on the above parcels and stated that <br />he recommended to the Planning Commission at their meeting on January 14, 1970, <br />that the Conditional Use Permit to California-Hawaiian Mobile Estates be left in <br />effect but it be modified by requesting that the representatives of California- <br />Hawafian relinquish their claim of the Overpack Conditional Use Permit in writing. <br />Mr. Hirst indicated that this Condition has been complied with. Mr. Hirst stated <br />that he also recommended to the Planning Commission that the Overpack Conditional <br />Use Permit of November, 1967, be reinstated. Mr. Hirst further recommended that <br />the appeal of Mr. Overpack in granting Conditional Use Permit No. 69-12, to Cali- <br />fornia-Hawaiian Mobile Estates, be dropped. Mr. Hirst further recommended that <br />Mr. Overpack submit a revised site plan in order to accommodate ].anger mobile homes <br />and that he be required to apply for a building permit within one year. <br />Mr. Jim Stacy, representing California-Hawaiian Mobile Estates, stated that he <br />has spent over $40,000.00, which is non-refundable, on this project, based upon a <br />letter he received from the City on June 26, 1969. Mr. Stacy indicated that this <br />letter informed him that if the Overpack litigation problems were resolved, the <br />combined properties could support 379 mobile home spaces, which would not be <br />objectionable for land use within the City of Pleasanton. Mr. Stacy concluded <br />that based on this information he agreed to annex his property to the City. <br />Councilman Rega asked Mr. Stacy to clarify his association with California- <br />Hawaiian Mobile Estates, Inc., and also with South Bay Land Company. Mr. Stacy <br />stated that he no longer held interest in California-Hawaiian but owned the South <br />Bay Land Company and the application for the Use Permit was requested when he had <br />been associated with California-Hawaiian. Mr. Stacy indicated that he had ob- <br />tained title to the subject property in payment for his California-Hawaiian stock. <br />There being no public protests, it was moved by Councilman Rega and seconded <br />by Councilman Reid that the public hearings be closed. <br />AYES: Councilmen Rega, Reid, Spiliotopoulos and Mayor Gerton <br />NOES: None <br />ABSENT: None <br />ABSTAINED:Councilman Beratlis <br />Councilman Beratlis abstained because he is the real estate broker for this <br />property. <br />NOES: Councilman Rega <br />F BSiNT : None <br />A~3t:iP.INED:Councilman Beratlis <br />Discussion regarding zoning, Conditional Use Permits and other related matters <br />ensued. <br />Councilman Rega indicated he was not in favor of rezoning the property to <br />multiple zoning as he felt it was not a proper use. <br />After considerable discussion, it was moved by Councilman Reid and seconded <br />by Councilman Spiliotopoulos that Ordinance No. 589, amending Ordinance No. 520, <br />rezoning from the Agricultural District to the RM-4000 (Multiple Family) District, <br />that property described as Parcel 14-4, Assessor's Map Book 946, Block 1250, also <br />cc%ramonly known as 3153 Vineyard Avenue, containing approximately 2l. acres, be <br />introduced. <br />_The roll call vote was as follows: <br />[-il'ES: Councilmen Reid, Spiliotopoulos an3 Mayor Gerton <br />d~~:;I~ped. <br />~'}~~ roll call vote was as follows: <br />It was moved by Councilman Rega and seconded by Councilman Reid that; 1) the <br />appeal of California-Hawaiian Mobile Estates, Incorporated, from an adverse deci- <br />sion of the Planning Commission in denying an application to rezone from the <br />Agricultural District to the RM-4000 (Multiple Family) District, that prop~-ty <br />described as Parcel 14-4, Assessor's Map Book 946, Block 1250, containiā€¢.:g ap;~roxi- <br />mately 21 acres, commonly known as 3153 Vineyard Avenue, and 2) that the appeal ~~f <br />J. :Layton Orr, Conservator of the Estate of A.
