WEED ABATEMENT CONTRACT THIS AGREEMENT is made and entered into this 27th day of April, 1988, by and between the CITY OF PLEASANTON, a municipal corporation (hereinafter referred to as "City"), and H & N ENTERPRISES, ROBERT NIELSEN, JR. (hereinafter referred to as Contractor"). WHEREAS, City has adopted a program for weed abatement pursuant to Government Code § 39560, et seq.; and WHEREAS, Contractor has agreed as an independent contractor, to work on an hourly basis to implement the Weed Abatement Program of City. NOW, THEREFORE, IN CONSIDERATION OF THE FAITHFUL PERFORMANCE OF THE TERMS AND CONDITIONS, PROMISES AND COVENANTS CONTAINED HEREIN, THE PARTIES HERETO AGREE AS FOLLOWS: I. That Contractor shall begin work upon receiving authorization from the City to proceed and shall complete all work within thirty (30) days of having been notified to commence abatement of weeds during the periods April I, 1988 through June 30, 1988 and April I, 1989 through June 30, 1989. Additional abatement required by the recurrence of a weed problem may be required after these stated periods as requested and scheduled by the City. 2. Contractor shall discharge his obligations under this agreement in accordance with the "Specifications for Weed Abatement," and "Weed Abatement Program Bid Sheet," and "Notice Calling for Bids for the Weed Abatement Program," used in the contract, all of which said documents are incorporated herein by this reference as if fully set forth; provided, however, that the requirements with respect to performance and materialsmen's bonds provided for in the specifications are hereby waived. 3. Contractor shall keep an accurate accounting of the cost of abatement in front of or on each separate parcel of property where work is done by him, and shall, upon completion of said weed abatement work, submit to the City Council an itemized written report showing such cost.
