Mayor Reid declared the public hearing open and asked for a staff <br />report. <br /> <br />Mr. Castro stated that since this matter was~ initiated by the Plan- <br />ning Commission, their findings are. unchanged and would reaffirm <br />their recommendation that the~subject.RM-4000' area be reclassified <br />to R-1-6~00. <br /> <br />There being no comments from the audience, it was moved by Council- <br />man Beratlis and seconded by Councilman Spitiotopoulos that the <br />public hearing be closed. <br /> <br />The roll Call vote was as follows: <br /> <br />AYES: Councilmen Beratlis, Pearson, Spiliotopoulos and Mayor <br /> Reid. <br />NOES: None <br />ABSENT: Councilman Gerton <br /> <br />It was moved by Councilman Spiliotopoulos and seconded by Councilman <br />Pearson that Ordinance No. 648, amending the 'zoning map' of the City <br />of Pleasanton, and an ordinance amending chapter 2, title II of the <br />ordinance code of the City of Pleasanton., rezoning from the RM-4000 <br />(Multi-Family) district to the RI-6500 (Single Family) District, a <br />Parcel of Property some two acres in size owned by H. Plato from an adverse decision <br />of the Planning Commission in denyling UP-71-28, '4-Flex to be located <br />on the southwest corner of Vineya~'d Avenue and M'avls Drive. <br /> <br />Mayor Reid declared the public hearing open and asked for a staff <br />report. <br /> <br />Mr. ttirst stated that the Planning Commission was concerned with the <br />land use on this property and the only available means of protesting <br />it was through the design review process. He further stated that the <br />Planning Commission was desirous of' putting this property into a Study <br />District to study land use and hold a public'hearing. <br /> <br />Mr. Castro stated that this can be considered at the Planning Commission <br />meeting of January 18th. <br /> <br />Mr. C. J. Potts, 367 Mavis Drive, questioned Councilman Beratlis' <br />conflict of interest if he voted on this issue as 'he was the realtor <br />or originally sold the property. Fe a]~o claimed that Councilman <br />Beratlis sold him his home without t~lling him that the subject was <br />zoned multiple. <br /> <br />Councilman Beratlis replied that the City Attorney had ruled he had no <br />legal conflict of interest by voting on this matter and further steted <br /> <br /> 2. 1-3-72 <br /> <br /> <br />
