155 <br /> <br /> Mr. Jack Bras, representing Valley Realty, stated the final plans had been <br />approved by the Planning Commission and urged City Council approval for develop- <br />ment of this property. <br /> <br /> It was moved by Councilman Kinney, and seconded by Councilman Reid, that the <br />public hearing be closed. <br />The roll call vote was as follows: <br />AYES: Councilmen Herlihy, Kinney, Mori, Reid, and Mayor Pearson <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilman Kinney, and seconded by Councilman Mori, that <br />Ordinance No. 719, to be read by title only and waiving further reading thereof, <br />approving PUD-73-2, Valley Realty, a portion of final development plan for pro- <br />perty located at the Northwest corner of Valley Avenue and Santa Rita Road, <br />Pleasanton, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmen Herlihy, Kinney, Mori, and Mayor Pearson <br />NOES: Councilman Reid <br />ABSENT: None <br /> <br />MATTERS CONTINUED FOR DECISION <br /> There were no matters continued for decision scheduled for this meeting. <br /> <br />SPECIAL REPORTS <br />Request for Exemption of Foothill Road from Restricted Growth Policy <br /> Mr. Edgar stated that the action to be taken by the City Council regarding <br />this matter is whether or not to grant exemption of the City's Restricted Growth <br />policy on the property at the Southeast corner of Bernal Avenue and Foothill Road. <br /> <br /> Mr. Harris presented the background material on this property and displayed <br />map showing proposed development. He stated the property had been the subject <br />of a referendum and that zoning had been changed at that time to R-1-6500. <br /> <br /> Mr. Jack Cor!ey, Attorney representing Costanzo-Wilson Development Company, <br />stated this property had been annexed to the City in 1962-63, and has been un- <br />developable due to zoning and sewage problems. He stated that Costanzo-Wilson <br />has presented a viable plan for development of the property which is in compli- <br />ance with City requirements and acceptable to the community. He further stated <br />this would not set a precedent and urged City Council to exempt the subject <br />property from the City's Restricted Growth policy. <br /> <br /> Mr. Brad Hirst, of Costanzo-Wilson Development Company, presented the tenta- <br />tive plan for the property, stating it is their intent to develop the area to <br />rural characteristics and build to highest prestige. He stated that his firm <br />intends to apply for 54 of the 100 unallotted sewer connections in the V.C.S.D. <br />Plant on Pleasanton's schedule in order to sewer this property. <br /> <br /> Councilman Herlihy asked if bike paths could be dedicated along with the <br />rights-of-way on Bernal Avenue and Foothill Road. Mr. Hirst stated that they <br />would be. <br /> <br /> Councilman Herlihy also asked if application for the unallotted sewer <br />connections would in any way jeopardize our negotiations with V.C.S.D. Mr. <br />Scheidig advised him he did not believe that it would affect those negotia- <br />tions. <br /> <br /> Mayor Pearson stated he felt application for the unallotted connections <br />would complicate existing sewer capacity. <br /> <br /> Councilman Reid'asked if the City would give up any policing power by taking <br />exception to the Restricted Growth policy on this property. Mr. Scheidig ad- <br />vised him that City would to some degree give up police powers since maps <br />approved prior to the establishment of a growth rate would apply prospectively - <br />not retroactively. <br /> <br /> 2. 12/10/73 <br /> <br /> <br />
