<br /> currence with the Vintage Hills Homeowners AssociationQ He stated his firm pre-
<br /> sently has an agreement with a shopping center developer to develop the ten acres
<br /> of commercial lando He further stated the approval of a convenience market would
<br /> delay development of the proposed center and he urged denial of the rezoning
<br /> application. He added he hoped to begin construction in the next year for this
<br /> commercial development.

<br /> thanked the City Council for their cooperation and interest in hearing the testi-
<br /> mony of residents in the area~

<br /> Mr. Lloyd W. Haines, 999 E. Stanley Blvd,, Livermore, attorney representing
<br /> H. C. Elliott, Inc., urged denial of the Pico application.

<br /> Petitions were presented to the City Council by various residents, showing
<br /> 154 signatures in opposition to rezoning and 3 in favor of it. Also, 18 residents
<br /> signed affidavits that they had received no written notification of the proposed
<br /> rezoning~

<br /> Councilman Kinney clarified his statements quoted in the newspaper regarding
<br /> the legislative process and stated his decision on the Pico Investors applica-
<br /> tion would be made on what he felt was in the best interest of the community for
<br /> good ].and usage and the changing demand of growth. He stated he felt there was
<br /> a good deal of merit in the application°
<br />
<br /> C{.~uncilman Herlihy stated that as a Councilman he had to look at both sides
<br /> of the application and his basic reasons for favoring the rezoning were to re-
<br /> duce traffic on Vineyard Avenue, the pending as rationing element, no assurance
<br /> that the Elliott property will be developed in the foreseeable future, sewer
<br /> capacity problems, and the slower growth rate to the East. He added he felt
<br /> the application was valid but would like to have it referred back to the
<br /> Planning Commission for further review, and also to receive additional infor-
<br /> mation from Elltort regarding their development plans.
