MINUTES of THE MEETING of THE CITY COUNCIL June 3, 1976 CALL TO ORDER - PLEDGE TO THE FLAG Mayor Robert Philcox called the Adjourned Regular Meeting of the City Council to order at 8:15 P.M~, and then led the Pledge of Allegiance to the flag. ROLL CALL Deputy City Clerk Doris George called the roll which is recorded as follows: Councilmembers Brandes, Herlihy, LoCisire, Mercer, and Mayor Philcox were present. Mr. Edgar, City Manager, Mr. Scheidig, City Attorney, Mr. Harris, Director of Planning, and Mro Sooby, Director of Engineering Services, were present. PUBLIC HEARINGS Appeal. of the Decision of the City Manager to file a Negative Declaration for UP-76-11~ an application for a Conditional Use Permit to construct and operate a Service Station on the Northwest Corner of Hopyard Road and Johnson Industrial Drive (Continued Open from 5-24-76) Councilmember Mercer abstained from participating on this item because of a moral conflict of interesto Mr. Edgar stated that 1,153 post cards had been received at City Hall this week, addressed to the City Council, in support of a self-service gasoline station at Hopyard Road and Johnson Industrial Drive, and presented the list to the City Council. He also presented a report of the Director of Engineering Services dated June 2, 1976, regarding traffic impact of the proposed service station. Mr. Harris presented his staff report dated May 18, 1976, regarding this matter. Mayor Philcox declared the public hearing open. Mr. Joe Schwab, Attorney, representing the appellant, stated he was concerned with the speed at which this application was being processed. He listed the reasons for which he felt an Environmental Impact Report was essential as being that aesthetically there is a strong possibility that it will cause harm to the community and the traffic circulation impact. He also stated that the economic impact should be considered in deciding whether or not to require an Environ- mental Impact Report° Mro Schwab quoted from a Planning Report dated 1969 which reconm~ended that a service station application be denied at this location because of an o~l-saturaticn of service stations in this area. He also stated that Coun<'~ ~xp~ssed concern about an over-abundance of service stations at the time the Exxon Station on Hopyard Road and Valley Avenue was permitted to be constructed. Mr~ Schwab coneladed by stating that his client felt that an Environmental Impact Re~o'rt was necessary in order to get the full picture, and requested approval of the appeal of the City Manager's Negative Declaration decision. MT~ ~,,~illiam Hirst, At[orney, representing Vernon Dickman, the owner of the property in question, stated he had reviewed the Notice of Intent and the staff reports and was in agreement with them, and that he felt there would be no ad- verse aesthetic ilapact on the community because of this development, nor would it ~.reate any significant traffic impact as there would be no ingress or egress onto Hop~ard Road directly from this proposed service station. He stated the application should be heard on its merits and respectfully requested denial of the appeal. Mrs~ Anna Martinsen, 4038 Payne Road, read a letter from Mro Don Savory, 6738 Rancho Court, which expressed concern about any development on this corner because of traffic and its possible long range affect upon the widening of Hop- yard Road~ He stated he felt that the proposed development would have signifi- cant adverse affect on the City o~ Pleasanton and the citizens of Pleasanton, and he requested that an Environmental Impact Report be made.
