391 MEETING OPEN TO THE PUBLIC Mr. Harry Regan, Realtor, 397 Ray Street, requested that a crosswalk be placed across Main Street at Ray Street. Mr. Campbell informed Council that this was a legal unmarked crosswalk area at an intersection. It was moved by Councilmember LeClaire, and seconded by Councilmember Mercer, that staff be instructed to paint crosswalk stripping across Main Street at the Ray Street Intersection. The roll call vote was as follows: AYES: Councilmembers Brandes, Herlihy, LeClaire, Mercer, and Mayor Philcox NOES: None ABSENT: None PUBLIC HEARINGS Request ~Z. John P. Vizzolini for removal of one Modesto Ash Heritage Tree located at 880 Division Street Mr. Sooby presented his report dated April 16, 1976, regarding this matter. Mayor Philcox declared the public hearing open. No one in the audience spoke in favor of or in opposition to this item. Mayor Philcox declared the public hearing closed. It was moved by Councilmember Mercer, and seconded by Councilmember Brandes, that Resolution No. 76-91, approving the request by John P. Vissolini for removal of one Modesto Ash Heritage Tree located at 880 Division Street, be adopted. Rx.!-6500 (single Family Residential) District Mr. Harris presented his staff report dated April 21, 1976, regarding this matter. Mayor Philcox declared the public hearing open. Mr. Henry Gomez, 1815 Brooktree Way, presented letters from neighbors in his area stating they were not opposed to the building addition. He stated this request was a hardship case because of his invalid father who resides at this address. There being no further testimony, Mayor Philcox declared the public hearing closed. Councilmember Brandes stated he requested this appeal because he felt there was not sufficient Justification to grant the Varience, and was concerned about the provisions under which Variences could be granted and the strength of the Ordinance. Council discussion ensued regarding the merits of granting this Varience because of the hardship facts presented in this case and the findings and determinations made by the Planning Commission in approving the same. 2. 4/26/76
