391 <br /> <br />MEETING OPEN TO THE PUBLIC <br /> Mr. Harry Regan, Realtor, 397 Ray Street, requested that a crosswalk be <br />placed across Main Street at Ray Street. <br /> <br /> Mr. Campbell informed Council that this was a legal unmarked crosswalk area <br />at an intersection. <br /> <br /> It was moved by Councilmember LeClaire, and seconded by Councilmember Mercer, <br />that staff be instructed to paint crosswalk stripping across Main Street at the <br />Ray Street Intersection. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, LeClaire, Mercer, and Mayor Philcox <br />NOES: None <br />ABSENT: None <br /> <br />PUBLIC HEARINGS <br />Request ~Z. John P. Vizzolini for removal of one Modesto Ash Heritage Tree located <br />at 880 Division Street <br /> Mr. Sooby presented his report dated April 16, 1976, regarding this matter. <br /> <br /> Mayor Philcox declared the public hearing open. <br /> <br /> No one in the audience spoke in favor of or in opposition to this item. <br /> Mayor Philcox declared the public hearing closed. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Brandes, <br />that Resolution No. 76-91, approving the request by John P. Way~ which would encroach into the required rear <br />yard on the property~ zonin~ for the property is. Rx.!-6500 (single Family <br />Residential) District <br /> Mr. Harris presented his staff report dated April 21, 1976, regarding this <br />matter. <br /> <br /> Mayor Philcox declared the public hearing open. <br /> <br /> Mr. Henry Gomez, 1815 Brooktree Way, presented letters from neighbors in his <br />area stating they were not opposed to the building addition. He stated this <br />request was a hardship case because of his invalid father who resides at this <br />address. <br /> <br /> There being no further testimony, Mayor Philcox declared the public hearing <br />closed. <br /> <br /> Councilmember Brandes stated he requested this appeal because he felt there <br />was not sufficient Justification to grant the Varience, and was concerned about <br />the provisions under which Variences could be granted and the strength of the <br />Ordinance. <br /> <br /> Council discussion ensued regarding the merits of granting this Varience <br />because of the hardship facts presented in this case and the findings and <br />determinations made by the Planning Commission in approving the same. <br /> <br /> 2. 4/26/76 <br /> <br /> <br />
