Mr. Scheidig advised Council that authority for median breaks can be <br />established by the City Council or the City Traffic Engineer. If the Council <br />desires to rule on this matter, the design of the center would go back to the <br />Design Review Board for review and recommendation. The Design Review decision <br />should be conditioned on approval of any median breaks authorized by the City <br />C~uncil. The City Council would pass upon median breaks on Hopyard Road and <br />Valley Avenue recommended by the City Engineer. <br /> <br /> After considerable discussion, it was moved by Councilmember Brandes, and <br />seconded by Councilmember Herlihy, that Resolution No. 77-10, granting with <br />prejudice the appeal of Charlotte Witke and Kay Martin to a decision of the <br />Planning Commission approving UP-76-31, a conditional use permit to allow the <br />construction and use of a shopping center complex on a site located west of the <br />rear of residences on Longspur Way, south of the Pleasanton Canal, and north <br />of Valley Avenue, ~he shopping center complex would require some required off- <br />street parking to be located on P (Public and Institutional) District land <br />located between the proposed shopping center and the residences on Longspur <br />Way, zoning for the site is C-C (Central Commercial) District (3.6 acres) and <br />P (Public and Institutional) District (1.8 acres), be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, Mercer, and Vice Mayor LeClaire <br />NOES: None <br />ABSENT: None <br />ABSTAINED:Mayor Philcox <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mercer, <br />that Resolution No. 77-11, requiring City Council approval of median breaks on <br />Hopyard Road and Valley Avenue in the vicinity of the proposed shopping center, <br />be adopted. <br />The roll call vote was recorded as follows: <br />AYES: Councilmembers Brandes, Herlihy, Mercer, and Vice Mayor LeClaire <br />NOES: None <br />ABSENT: None <br />ABSTAINED:Mayor Philcox <br /> <br /> It was moved by Vice Mayor LeClaire, and seconded by Councilmember Herlihy, <br />to express the desire of the City Council to the Design Review Board that <br />consideration be given to the creation of barriers to effectively prohibit <br />parking from occurring on the P zoned property. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, Mercer, and Vice Mayor LeClaire <br />NOES: None <br />ABSENT: None <br />ABSTAINED:Mayor ~hilcox <br /> <br /> Vice Mayor LeClaire returned control of the meeting to Mayor Philcox. <br /> <br />Adoption of a revised Resolution of the City Council of the City of Pleasanton <br />Adopt.in5 a Conflict of Interest Code Applicable to the Members of the City. <br />Council Pursuant to the Political Reform Act of 1974 <br /> Mr. Scheidig presented his report dated January 5, 1977, regarding this matter. <br /> <br /> Councilmember Mercer stated he felt the same revision should apply to the <br />local conflict of interest codes to be adopted by the City. <br /> <br /> 4. 1/10/77 <br /> <br /> <br />
