were not met by the Cheese Factory was not appropriate and urged that it be <br /> deleted. <br /> <br /> Councilmember Brandes stated he felt the Cheese Factory had been given ample <br /> time to comply with the conditions of the Permit. <br /> <br /> Discussion ensued between Council and George Spiliotopoulos regarding the <br /> conditions of the Permit that had been complied with, the ones remaining to be <br /> complied with and when they would be completed, and an agreeable solution to <br /> the Cheese Factory discharge problem. <br /> <br /> It was moved by Councilmember LeClaire, that the Cheese Factory Discharge <br /> Permit be reissued subject to the recommendations contained in the report of <br /> the Director of Public Works and Utilities dated November 21, 1977. <br /> <br /> The motion died for lack of a second. <br /> <br /> It was moved by Councilmember Mercer that a new Discharge Permit be issued <br />to the Cheese Factory with the same conditions as the existing Permit, that an <br />allowance of thirty (30) days be granted until the new mechanism is installed <br />and proven, allow the Cheese Factory sixty (60) days to hire an engineer if <br />necessary to reduce the COD and BOD, and allow one hundred twenty (120) days <br />for completion of a report that would improve the COD and BOD content, and <br />that all conditions be met within thirty (30) days with the exception of Nos. <br />4 5 and 7 (BOD, COD, and SS) <br /> <br /> After further discussion, Councilmember Mercer withdrew his motion. <br /> <br /> It was moved by I,~yor Philcox, and seconded by Councilmember LeClaire, that <br />a Discharge Permit be issued to the Cheese Factory for a six month period subject <br />to the following recommendations: (1) that the Standard Cheese Company be re- <br />quired to meet all of the remaining conditions of the permit within thirty (30) <br />days from the date of issuance of the permit, except the limits on BOD, COD and <br />SS; (2) that the Standard Cheese Company be required to contract with a recognized <br />Sanitary Engineer or Firm, satisfactory to the City Manager, within the next <br />sixty (60) days from the date of issuance of the permit, for the purpose of making <br />a comprehensive study of the Cheese Factory Industrial Waste Discharge problem, <br />such study to investigate technical alternatives, their costs and the economic <br />feasibility and impact of the Cheese Factory meeting the Code requirements, the <br />existing permit requirements or any recommended requirements for BOD and SS, and <br />said study to be complete and copies forwarded to the City for review with one <br />hundred eight (180) days from the date of issuance of the permit; and (3) that <br />the City Council states its intent to find the Standard Cheese Company in vio- <br />lation of its permit and the City Code if the terms of the permit and time limits <br />therein are not met, and further states its intent to issue a cease and desist <br />order prohibiting further discharge by the Standard Cheese Company if the above <br />requirements have not been met in the time period specified. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, LeClaire, Mercer, and Mayor Philcox <br />NOES: None <br />ABSENT: None <br /> <br /> Councilmamber Brandes stated he would have difficult in granting any further <br />extention. <br /> <br /> 6. 11/29/77 <br /> <br /> <br />
