Mr. Oliver H. Anjo, 2403 Raven Road, stated he felt all remarks presented <br />by persons other than Pleasanton residents should be stricken from the Minutes. <br /> <br /> Mr. Paul Tull, 2243 Linden Street, Livermore, spoke regarding LA~qMA Reso- <br />lution No. 77-10 and his interpretation of it. He urged acceptance of the <br />Referendum Petition. <br /> <br /> Mr. John Fraga, 1486 Kolln Street, representing CARD, expressed dissatis- <br />faction with his cooperation from the City Attorney in securing pertinent <br />information and assistance for proper wording on the Petition. Mayor Philcox <br />asked Mr. Fraga if the wording on the Petition that was circulated was the same <br />as he submitted to the City Attorney's office. Mr. Fraga stated it was not. <br />Mr. Fraga also stated CARD had been denied input into LAVWMA matters, and that <br />CARD had waited for City Council final action on the Joint Powers Agreement and <br />amendments before taking action. <br /> <br /> ~. Gene Rhodes, representing Alameda County Water District Board, stressed <br />the importance of the project for the entire County and urged all deadlines be <br />met for grant assistance. He explained the claims filed by Alameda County Water <br />District against Livermore and V.C.S.D., and stated that Pleasanton could become <br />liable if the LAVWMA project fails. <br /> <br /> }~. Larry Walker, Executive Director, State Water Resources Control Board, <br />spoke regarding funding of the project. He stated that it is possible that <br />Federal funds would be available after the September 30th deadline, but that <br />State funding was limited and could only be guaranteed to September 30th. tle <br />szated that completed design drawings and specifications had to be approved by <br />Sta~e ~ter Board staff prior to September 30th, and local financing assured <br />before grant funding would be approved. He added that a Referendum suit against <br />the City would not necessarily affect Federal and State funding since the design <br />of the project is so far along and the intent of the agencies involved has been <br />in favor of the project. However, he indicated that if a suit were filed the <br />State would have to look at the pleadings, the possible affect upon the project, <br />and decide whether or not to hold grant monies for the project. Mr. Walker also <br />stated that if Council accepted the Referendum Petition it was his opinion the <br />State would not be willing to approve the Clean Water Grant. <br /> <br /> Mr. Larry Kolb, representing Regional Water Quality Control Board, San <br />Francisco Bay Region, spoke regarding that Board's concern relative to waste- <br />water disposal in the Valley and explained the actions taken against Livermore <br />and V.C.S.D. He stated that since Pleasanton is on record as to its intent of <br />phasing out of the Sunol Plant and consolidation with V.C.S.D., the City was <br />not affected at this time by Regional Cease and Desist Order restrictions. <br />However, if Pleasanton took any action to delay the project and jeopardize <br />funding, the Regional Board would pursue action against the City. The Regional <br />Board has required that the wastewater problem in tha Valley be solved. Mr. <br />Koib urged Council compliance in meeting deadlines to secure grant funding for <br />the EA~ project. <br /> <br /> Mr. David Eller, 3797 Oregon Way, Livermore, asked various questions re- <br />garding deadlines and fundings. <br /> <br /> Mr. Thurman Claudell, Augustine Street, stated he felt the people who signed <br />the Petition knew what they were signing and want to vote on the matter again. <br /> <br /> 5. 7/25/77 <br /> <br /> <br />
